' <br /> I. Qn Februaiy 28, ZQ13, the City and the Owners entered into a temporary 9Q- <br /> daylicense agreement to allow the City and Boatowners for the failowing purposes: <br /> 1. To gain access to the Marina and their boats; <br /> 2. Parking their cars, <br /> 3. Use of a partion of a building for the limitecl use of bathrooms, sl�awers <br /> ' and laundry facilities; <br /> 4. Tying into utilities serving the Property; <br /> 5; Use of the Yacht Club;and <br /> 6.' Use of the Hart�or Nlaster Building. <br /> J. On May 31, 2013, the City and the Owners extended that license another 3U days for <br /> the same pu�poses. <br /> K. Now that the City has begun managing the Marina and better understands the <br /> operatians thereof, the City seeks to entcr into an extended teiuporary license <br /> agreement to continue using portions of the Property, outlined in red on E�hibit A <br /> attached hereto, for the: same purpases identified abave while the City continues to <br /> study the future of the Inner Harbor area. - <br /> L. The Owners and the City now desire ta enter inta a l-year license agreement to allow <br /> for further use of the Property, all as set fortli below. <br /> NOW THEREFORE,the parties hereto agree as fallows: <br /> 1. The Owners graiit the City a temporary license (the "License") to use <br /> portions of the Property during the term of the Agreement solely for the purpose of <br /> managing the Marina and allowing the Boatowners to use portions of the Property for the <br /> liuiited purposes described in Recital E to this Agreernent. The map attached hereto as <br /> Exhibit A shows the �reas of the Property subject to tiiis L'tcense Agreement (the <br /> "Premises"). The City shall confer such rights of use to tlie Boatowners fhraugh <br /> subliceiise{the"Subliceiises"), the terms of which shall be expressly made subj�ct to this <br /> Agreement and the terms of which shall be consistent with the term5 and provisions of <br /> this Agreement. Teiiancies or use permits by which the City pei7nits the Boatowners to <br /> use tl�e Greek are collectively referred to as the "Marina Tenancies". The premises are <br /> delineated as betweeu the street entrance (at Maple Street) and the red line on Exhibit A <br /> which prohibits parkiiig or personal property beyond th�t point by either City or its <br /> sublicensees. Pedestrian and bicycle access will be permitted beyond that line alang the <br /> Redwood Creek boundary to the Owner's property until the earlier of(1)the terniination <br /> of the License, or (2) the time at which the City is able to accon�modate an alteniative <br /> route of ingress and egress in fi-ont of or on the adjacent property owned by thc County. <br /> The City will undertake good faith efforts to deteimiiie an alternative route and will not. <br /> use tlie Licensc to allaw public recreational access to the Property.
