Natwithstanding the <br /> faregoing, the parties recognize that the Cit�'s ability to utilize the I'rernises is currently <br /> impaired by the existenGe of unauthorized �nd/ar abandoned vehicles on the Premises. <br /> The City and the Owners agree tv work cooperatively to identify which vehicles currently <br /> located on the Premises are unauthoriz�d andfc�r abandoned and in nee�1 of renioval. <br /> Qnee this detertnination is made, the Owners agree to have the identified vehicles <br /> rernoved froxn tlie Premises in campliance with applicable laws, statates,or regulations as <br /> soon as legally practicable. <br /> 4. So long as this A�?reement is in eff�ct, on the first day of each month, thc <br /> City shall pay the Owners a monthly license fee of$7,500. <br /> 5. The initial term of this Agreement is one (1) year comnlencing July l, <br /> 2Q13 and expiring on June 30,2014("Initial Term"). <br /> 6. During the term of this Agr�ement, the City shall cause the Premises a»d <br /> improvements thereon to be maintained in the same condition as the condition was turned <br /> over to City. The Owners retain the right without liability to the City ta enter upon the <br /> Pr�mises at any reasanable time: (ij to inspect the Premises, (ii) to show the Premises to <br /> prospective purchasers, (iii) to perform any tasks neeessary to facilitate the sale of the <br /> Premises, including but nof limited to geotechnical investigations, property surveys and <br /> aiiy other similar tasks, (iv) to perform any covenants of the City which the City fails to <br /> perfonn, (v) to perform any i-epairs or atterations not requirEd to be n�ade by fhe City <br /> hereunder; (vi) as reasanably necessary for the fJwners' management of their Property <br /> located adjacent to ths Prenlises; or (vii) to remove any abandoned ar derelict vehicles <br /> fronl the Premises. The Owners shall take all reasanable steps to minimize interference <br /> with the City's operation of the Marina resulting fram any such re-entry aud shall <br /> cooperate to the extent neeessary to enable the removal of the abandoned or derelict <br /> vehicles. <br /> 7. The City shall be responsible for all utilities utilized by the City or� the <br /> BoatowY�ers serving the buildings on the Premises and the Marina or othelvvise utilized <br /> by the Boatowners or the City. <br /> $.
