7.2.D. - Page 2 <br /> sidewalk and right -of -way improvements falls to them. Architectural Permits for 353 and <br /> 355 Alameda de las Pulgas were approved on May 9, 2014. <br /> The owners are seeking relief from the requirement to construct improvements to one <br /> half of Alameda de las Pulgas from Harding Avenue to the Hetch Hetchy, and are <br /> requesting to only construct or fund the construction of the sidewalk and right -of -way <br /> improvements along the frontage of their two lots. Such relief would require the City <br /> Council to enter into an Improvement Agreement and allow for collection of in -lieu fees, <br /> and make a determination as to the responsible party(ies) moving forward. <br /> The Subdivision Committee, which meets infrequently (as needed), has duties defined <br /> within Section 30.21 Municipal Code. The Subdivision Committee is comprised of the <br /> Planning Manager, Engineering Manager and Planning Commission Chair. The request <br /> was taken to the Subdivision Committee on April 23, 2014, and was continued to June <br /> 4, 2014 with direction that staff review the feasibility of a "piecemeal" approach to <br /> construction. Several neighbors along Alameda attended the Subdivision Committee <br /> hearings and voiced their concerns about potential drainage impacts and the fact that <br /> they had been promised sidewalk and roadway improvements at the time of the <br /> Annexation. At their June 4 hearing, based on information and opinions provided by <br /> staff and the neighbors, the Committee made a recommendation that the Council <br /> require the improvements to be constructed as a single project and not in a piecemeal <br /> fashion. The Committee was concerned that construction of improvements in a <br /> piecemeal fashion could potentially create drainage issues for adjacent and nearby <br /> properties where there are no frontage improvements, as the properties in this location <br /> are at a lower elevation than the street. Additionally, the construction of sidewalk <br /> improvements in a piecemeal fashion would not create the continuous, pedestrian - <br /> friendly sidewalk that was intended by the condition placed on the annexation, and <br /> could even create a hazardous condition for pedestrians as it would allow for the <br /> sidewalk to stop and start, with no definite completion date for the full sidewalk <br /> improvements. The Committee did not recommend a way to implement or fund the <br /> construction and left all options open and to the discretion of the Council. <br /> ANALYSIS <br /> Staff believes that an Improvement Agreement between the City and the owners, <br /> allowing for payment of in -lieu fees with the City funding the remaining scope of <br /> improvements as a future CIP project, is a reasonable compromise that provides some <br /> level of benefit to all parties involved. The owners would pay up -front fees and move <br /> forward with the development of their properties; the City would receive funds toward <br /> the future improvement of Alameda de las Pulgas; and the affected property owners <br /> along Alameda would get the sidewalk and right -of -way improvements that they were <br /> promised at the time of annexation. <br /> Based on engineering estimates, the cost to design the full scope of the project will be <br /> approximately $45,000 and the construction costs will be $357,000, for a total cost of <br /> $402,000. Staff recommends that the owners fund the full cost of design plus a <br /> proportional share of the construction costs based on the linear frontage of their two <br />
