7.2.D. - Page 17 <br /> SIDEWALK AND RIGHT -OF -WAY IMPROVEMENT AGREEMENT <br /> 353 AND 355 ALAMEDA DE LAS PULGAS <br /> (APNS: 058 - 252 -110 AND 058 - 252 -100) <br /> THIS SIDEWALK AND RIGHT -OF -WAY IMPROVEMENT AGREEMENT <br /> ( "Agreement ") is entered into this '21 day of 5 �'4 , 2014 ( "Effective Date "), by and <br /> between the CITY OF REDWOOD CITY, a municipal orporation ( "City ") and RICKY HUNG <br /> NGO, a married man, and YUNG LE, a married woman (collectively, "Property Owners "). <br /> City and Property Owners are sometimes referred to herein individually as a "Party" and <br /> collectively as the "Parties." <br /> RECITALS <br /> A. Property Owners own certain real property located in the City of Redwood City, <br /> County of San Mateo, State of California, consisting of two legal parcels commonly addressed as <br /> 353 and 355 Alameda de las Pulgas, identified by San Mateo County Assessor Parcel Numbers <br /> 058- 252 -110 and 058- 252 -100, respectively, and more particularly described in Exhibit A <br /> attached hereto and incorporated by reference (the "Property "). <br /> B. On October 24, 2006, the Redwood City Planning Commission ( "Planning <br /> Commission ") reviewed an application by Property Owners' predecessor in interest, E.J. Polati <br /> ( "Original Applicant ") for pre - zoning and annexation of his property located at 343, Alameda <br /> de las Pulgas along with three other adjacent parcels located 257, 367 and 375 Alameda de las <br /> Pulgas as well as a portion of the Alameda de las Pulgas between Harding Avenue up to the <br /> Hetch Hetchy right -of -way (the "Annexed Property ") and made a recommendation to the <br /> Redwood City City Council ( "City Council ") to initiate a Zoning Map Amendment to pre -zone <br /> the subject properties to Residential Single Family R -1, subject to certain conditions. <br /> C. On November 3, 2007, the Redwood City Subdivision Committee ( "Subdivision <br /> Committee ") approved an application by Original Applicant for a Tentative Parcel Map to <br /> subdivide the property located at 343 Alameda de las Pulgas into three (3) lots, being 343 <br /> Alameda de las Pulgas (with an existing home) and 353 and 355 Alameda de las Pulgas (two <br /> new vacant lots), contingent upon annexation of the property into Redwood City, subject to <br /> various conditions. <br /> D. On January 14, 2008, the City Council introduced an ordinance to pre -zone the <br /> Annexed Property to Residential Single Family R -1. <br /> E. On June 18, 2008, the San Mateo County Local Agency Formation Committee <br /> ( "LAFCO ") approved the proposed annexation. <br /> F. On July 18, 2008, 30 days after the LAFCO approval, the annexation became <br /> effective and the pre - zoning became the new zoning designation for the Annexed Property. <br /> G. The annexation transferred a section of Alameda de Las Pulgas from the County <br /> of San Mateo's jurisdiction to the City's jurisdiction. This roadway lacked curbs, gutters, and <br /> sidewalks and did not meet existing City standards.
