8.A. - Page 3 <br /> • Resolution of Intention <br /> • A copy of the Management District Plan <br /> The mail ballots had to be received by the City Clerk by the conclusion of the public <br /> hearing scheduled for July 28, 2014. <br /> ANALYSIS <br /> The July 28, 2014 public hearing will provide property owners an opportunity to voice <br /> their opinions regarding the formation of the district and cast their votes for or against <br /> the district in a public forum. <br /> Ballots are accepted until the close of the public hearing. At the close of the public <br /> hearing, staff will ask the Mayor to recess the meeting and the City Clerk or her <br /> designee(s) will convene inside the Council Chambers to unseal and tally the ballots. <br /> Once completed, the City Clerk will request that the Mayor re- convene the meeting and <br /> staff will present the final ballot count and the agenda item will re- commence. Ballots <br /> are weighted by the amount of assessment they represent. <br /> If the weighted ballot count in support of the assessment is not exceeded by the <br /> weighted ballot count in opposition to the assessment, the City Council may introduce <br /> the Ordinance of Formation that forms the CBID and the assessments on the benefitting <br /> parcels. The City would then inform the County to levy the assessments on the next <br /> cycle of property tax bills consistent with the amounts listed in the Management District <br /> Plan and Assessment Engineer's report. The City would need to enter into a formal <br /> agreement for compensation to the County of San Mateo for collection of Special <br /> Assessments by July 31, 2014, (Sample agreement is attached as attachment #4) in <br /> order to allow the County to collect these assessments on the City's behalf. The City <br /> will bill tax exempt parcels directly. <br /> The assessments generally appear as a line item on the property tax bills. When the <br /> funds are collected (twice annually in December and June), the County will send a <br /> check to the City. Once a non - profit management corporation has been established, <br /> the City will contract with that corporation to provide the CBID services. <br /> It is anticipated that the Steering Committee will begin work immediately on the non- <br /> profit corporation and establishment of an interim Board of Directors once the <br /> Ordinance of Formation is adopted. An agreement with the interim Board of the new <br /> non - profit management corporation will likely take 90 - 120 days. In the meantime, City <br /> staff will work closely with the Steering Committee to ensure the work of establishing <br /> and executing this new program proceeds effectively and efficiently. Staff will return, on <br /> a date to be determined, to the City Council for approval of the contract with the non- <br />
