<br /> WHEREAS, the Draft Environmental Impact Report for the Project ( "Draft
<br /> EIR ") was circulated for public review and comment for 45 days beginning on
<br /> August 2, 2013 and ending on September 16, 2013, and was filed with the State
<br /> Office of Planning and Research under State Clearinghouse No. 2013012016.
<br /> During this review period, the City received letters and emails from the public; and
<br /> WHEREAS, on September 3, 2013, the Commission held a duly noticed
<br /> public hearing and received public testimony on the Draft EIR and the Project; and
<br /> WHEREAS, the City prepared written responses to the comments received
<br /> during the Draft EIR public review period and included these responses in the Final
<br /> EIR and prepared a separate document entitled, "Mitigation Monitoring and
<br /> Reporting Program Cambridge Academy Project, SCH# 2013012016, November
<br /> 2013," which together with the Draft EIR constitutes the Final EIR; and
<br /> WHEREAS, on November 8, 2013, the City released the Final EIR fora 10-
<br /> day public review period pursuant to CEQA and the CEQA Guidelines; and
<br /> WHEREAS, on December 10, 2013, the Commission conducted a duly
<br /> noticed public hearing, in accordance with all applicable requirements of the State
<br /> Planning and Zoning Law and the Redwood City Zoning Ordinance, received and
<br /> considered oral and documentary evidence on the application, considered and
<br /> certified the Final EIR for the Project prepared in accordance with the requirements
<br /> of CEQA, the CEQA Guidelines, and the Redwood City Municipal Code and
<br /> Zoning Ordinance, did not adopt the Statements of Overriding Consideration, did
<br /> not adopt the CEQA Findings of Fact, denied the Use Permit application, and
<br /> directed staff to return to the Commission with revised resolutions for denial of the
<br /> Project; and
<br /> WHEREAS, on February 4, 2014, the Commission reviewed revised
<br /> Planning Commission Resolution Nos. 13 -29 and 13 -30, certifying the Final EIR,
<br /> not adopting the Statements of Overriding Consideration, not adopting the CEQA
<br /> Findings of Fact, and denied the Use Permit application; and
<br /> WHEREAS, on February 18, 2014, Applicants filed a timely appeal; and
<br /> WHEREAS, on July 28, 2014, the City Council conducted a duly noticed
<br /> public hearing to consider the appeal, in accordance with all applicable
<br /> requirements of the State Planning and Zoning Law and the Redwood City Zoning
<br /> Ordinance, received and considered oral and documentary evidence on the
<br /> application, considered and certified the Final EIR for the Project prepared in
<br /> accordance with the requirements of CEQA, the CEQA Guidelines, and the
<br /> Redwood City Municipal Code and Zoning Ordinance, adopt the Statements of
<br /> Overriding Consideration, and adopt the CEQA Findings of Fact.
