<br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
<br /> CITY OF REDWOOD CITY, AS FOLLOWS:
<br /> Section 1. The City Council finds that the above recitals are accurate
<br /> and constitute findings in this matter and, together with the Staff Report and the
<br /> application materials, including without limitation the Final EIR, development plan,
<br /> and all other documents, reports, studies, memoranda, maps, oral and written
<br /> testimony, and materials in the City's file for the application and the Project, and
<br /> all adopted City planning documents relating to the Project and the property
<br /> including the City's General Plan, Municipal Code, Zoning Ordinance, and other
<br /> applicable City laws and regulations, and all associated approved and certified
<br /> environmental documents, have together served as an adequate and appropriate
<br /> evidentiary basis for the findings and actions set forth in this Resolution. The City
<br /> Council, having independently heard, considered, and weighed all the evidence in
<br /> the record, including evidence presented by City staff, the Applicant, and members
<br /> of the public, and being fully informed of the Project, the Planning Commission's
<br /> decision, and the appeal, in the exercise of its independent judgment, hereby
<br /> grants the appeal and overturns the Planning Commission Resolution No. 13 -29.
<br /> Section 2. The City of Redwood City is the lead agency under CEQA for
<br /> preparing the Final EIR and on appeal the City Council of the City of Redwood City
<br /> is the final "decisionmaking" body with regard to approval of the Cambridge
<br /> Academy Project under CEQA, the CEQA Guidelines, and the Redwood City
<br /> Municipal Code and Zoning Ordinance.
<br /> Section 3. The City Council certifies that the Final EIR for the Project was
<br /> presented to the City Council, that the Final EIR was prepared, published,
<br /> circulated, reviewed and completed in full compliance with State law, including but
<br /> not limited to CEQA and the CEQA Guidelines, that there was adequate public
<br /> review of the Draft EIR, that it has considered all comments on the Draft EIR and
<br /> responses to comments, that the Final EIR adequately discusses all significant
<br /> environmental issues, and that the Final EIR reflects the independent judgment
<br /> and analysis of the City Council.
<br /> Section 4. The City Council has reviewed and considered the information
<br /> contained in the Final EIR prior to acting on the proposed Cambridge Academy
<br /> Project.
<br /> Section 5. The information added to the Final EIR does not constitute
<br /> significant new information requiring recirculation, but rather that additional
<br /> information clarifies or amplifies an adequate EIR.
<br /> Section 6. As described in the Final EIR (Section 4.1 on p. 24 -27,
<br /> Sections 4.3 to 4.13 on p. 37 -80, and Section 5.0 on p. 81 -83, of the Draft EIR),
<br /> the Project would result in no or less than significant effects to the environment
<br /> relating to land use and planning, transportation, hazardous materials, air quality,
