With regard to hazards and <br /> hazardous materials impacts, as described in Section 4.4.3 on page 48 -49 of the <br /> Draft EIR, the Project's conformance with the regulatory requirements outlined in <br /> Section 4.4.3.1 would reduce the potential for the Project to result in hazardous <br /> material impacts to less- than - significant levels. <br /> Section 7. Pursuant to CEQA Section 21081.6 and CEQA Guidelines <br /> Section 15091, and in support of its approval of the Project, the City Council adopts <br /> the Mitigation Monitoring and Reporting Program to require all mitigation measures <br /> described in the Final EIR be implemented by means of Project conditions, <br /> agreements, or other measures, as set forth in the Mitigation Monitoring and <br /> Reporting Program attached as Exhibit A of this Resolution and incorporated <br /> herein by reference. Based on its approval and adoption of all mitigation measures <br /> described in the Final EIR, the City Council finds that the changes or alterations <br /> required by such mitigation measures will be incorporated into the Project and will <br /> avoid or substantially lessen all of the significant environmental effects identified <br /> in the Final EIR, except those effects from the noise impacts generated by the <br /> Project as described below. <br /> Section 8. The Final EIR identified significant and unavoidable noise <br /> impacts resulting from the Project's outdoor activities, both under Project - related <br /> outdoor activities (Section 4.2.3.2 on p. 32 -35 of the Draft EIR) and under <br /> cumulative conditions (Section 6.1.4 on p. 86 -88 of the Draft EIR), which considers <br /> the cumulative noise impact from project - related noise activities in combination <br /> with noise associated with the existing Montessori preschool onsite at full <br /> enrollment. Implementation of mitigation measures MM NOI -1 (Section 4.2.4.1 on <br /> p. 35 of the Draft EIR) and MM CUM NOI -1 (Section 6.1.5.1 on p. 88 of the Draft <br /> EIR), both of which require that a 7 -foot tall noise barrier be constructed between <br /> the proposed play areas and the adjacent residences as shown in Figure 4.2 -2 of <br /> the Draft EIR (p. 36), would reduce the Project's noise impacts but not to less than <br /> significant levels. To approve the project in accordance with CEQA Guidelines <br /> Section 15093, the Planning Commission must make a Statement of Overriding <br /> Considerations as discussed in Section 9 below. <br /> Section 9. The Final EIR analyzed alternatives to the proposed Project. <br /> Specifically, the Draft EIR analyzed three alternatives and a No Project Alternative <br /> as follows: <br /> a. No Project Alternative: In accordance with CEQA Guidelines <br /> Section 15126(d) (4), the Final EIR evaluated a No Project <br /> Alternative (Summary section on p. 3 and Section 7.2 on p. 93 of <br /> the Draft EIR), which shall address both the existing conditions, <br /> as well as what would be reasonably expected to occur in the <br /> foreseeable future if the Project is not approved, based on current <br /> ATTY /RESO.3003 /CC RESO CERT FEIR &ADOPTING SOC'S <br /> REV: 07 -22 -14 VR <br /> Page 4 of 9 <br />
