Mayor Gee commented on the issue of affordable housing and said it is better located
along the transit corridor (such as along the EI Camino Real) and this project is not the
right place because it is not along the transit corridor and is not served by public transit,
but this conversation will be continued under the Community Benefits discussion, which
has begun.
M/S Foust/Seybert to deny the appeal and to approve Planned Development (PD)
Permit including Parking Modifications, Vesting Tentative Map and Condominium Permit
based on the findings and subject to the Conditions of approval contained therein upon
consideration of Revised Addendum No. 2 and Addendum #2 with the revised Condition
6 and the revised resolution. Council Member Seybert provided some history on the
Zoning for the area and noted that this project is consistent with the General Plan and
meets the City's standards with regard to sea level rise. Another Council Member
supports the motion, adding that there has been extensive review and he is confident
and supports it, but said that affordable housing is a bigger issue and he believes the
demise of the RDA (Redevelopment Agency) took away funding mechanics for that
cause.
One Council Member said that she does not believe the appellant has proven her case
and so she will support the decision to deny the appeal. Another Council member also
thanked the community for coming out here and being present to listen to the discussion
and the process. Ms. Thompson, City Attorney, reiterated that this Condition does
require the developer to get the permits directly and then the developer may move
forward.
A Council Member said she spoke at the Commonwealth Club on the issue of sea level
rise. She said that BCDC used Redwood City as an example of a jurisdiction who is
doing many good things and she thanked the developer for this.
Mayor Gee said that this started a long time ago with Measure Q and he believes this
process conforms to that and this project complies with the voice of the people. He said
that Mr. Powers will need to get the permits with other agencies resolved and wished
him well on getting them resolved in a timely way. He supports the motion.
Recommendation:
Hold a Public Hearing and Adopt a Resolution (Attachment 1) Denying the
Appeal and approving the Planned Development (PD) Permit including
Parking Modifications, Vesting Tentative Map and Condominium Permit
based on the findings and subject to the conditions of approval contained
therein upon consideration of Revised Addendum No. 2 (dated February
2014) to the 2003 certified Marina Shores Village Environmental Impact
Report (2003 EIR).
CITY COUNCIL March 24, 2014
MEETING MINUTES PAGE 11
MINUTE BOOK NO. 65
Page No. 113
