City Manager (Oral) Update <br /> Dr. Bell said they are scheduling a Town Hall meeting for May 5th at the Redwood <br /> Shores Library. <br /> D. City Attorney Report from Closed Session <br /> Ms. Thompson reported out on the Closed Session regarding the Legal Aid Society <br /> (LAS) and the City Council, acting at the Successor to the Redevelopment Agency. The <br /> vote was 7-0 in favor of the Agency filing an appeal with regard to a trial court decision, <br /> while acknowledging that the over $10 million that the Agency had set aside for <br /> affordable housing purposes was an enforceable obligation; i.e., an enforceable <br /> contract with the LAS, which if the City does not fulfill that obligation, the court <br /> acknowledge that the LAS could sue the Agency. But despite that, the trial court <br /> acknowledged that the monies in those funds should be redistributed back to the taxing <br /> Agency because the Agency had not earmarked, yet, those funds to affordable housing <br /> projects. <br /> Mayor Gee clarified that Council had decided to appeal the judge's decision to take <br /> away the $10 million, because the City (through the Agency) had to support affordable <br /> housing. <br /> Ms. Thompson spoke on the second Closed Session item regarding the Save Laurel <br /> Way (SLW) petition that was filed in court. The Council had approved a project with <br /> modified home sizes due to the slope and SLW filed an appeal to challenge that. <br /> Subject to the City's law, the developer has an obligation to defend and indemnify the <br /> City. The developer will do that even though they had expressed dissatisfaction with the <br /> homes sizes because they had wanted larger home sizes. They have come to an <br /> agreement that subject to the city towing purported claims, the developer will go forward <br /> with that and the City Council authorized this on a 7-0 voice vote tonight and that <br /> agreement will be brought back at a future City Council meeting as a Consent Agenda <br /> item. <br /> 11.
