_
A. Recommendations from the Inner Harbor Specific Plan Task Force
relating to Uses and Circulation (613)
Recommendation:
Direct staff to proceed with preparation of and Environmental Impact Report
and Inner Harbor Specific Plan based on recommendations of the Inner
Harbor Specific Plan Task Force and discussion at the Joint Planning
Commission City Council Study Session
Mayor Gee convened the City Council meeting and asked Assistant City Manager
Ekern if he had anything further to add. Mr. Ekern responded that he would like direction
tonight on the uses of the area, and asked Council not to look at specific pieces. He
further explained that if the uses are acceptable by the Council, then Staff will continue
developing the documentation for the EIR.
Public Comment
Tania Sole, a Docktown resident, spoke about how her sewer disconnection last year
and opined that there was no reason for that. She hopes it gets reconnected by
Wednesday so she does not have to file a lawsuit. She also spoke about a veteran who
was forced to move away.
Jerry Pierce, a member of BIAC, said he is speaking as a community member in being
aware of the needs of the community, especially as it pertains to parks. He is excited
about the Inner Harbor Plan. He spoke about being a proud resident and mentioned
Redwood Shores, Bair Island, the Inner Harbor Specific Plan, and having a defined
regional and community space for recreation that combines parks, playing fields and
water access.
Reid Boggiano, a Public Land Management Specialist representing the State Lands
Commission, addressed the comments contained in the May 12th Staff report to City
Council about the city's pursuit of possible legislative remedies for residential uses on
the public trust lands granted to the city. He said the legislature has granted to the City
the control and management over the public trust lands underlying Docktown and the
State Lands Commission is vested in residual oversight of the property and is
responsible for ensuring that local trustees are complying with the public trust and
statutes. In a letter from the Commission Staff that was sent to the City on February 25,
2014, they explained their stance, that based on advice from the Attorney General's
Office on sovereign lands such as those underlying this floating home community, this
residential use only benefits a select few rather than the statewide public, it is not water
dependent, and it impairs public access to and enjoyment of sovereign lands. He
further stated that the Commission looks forward to continuing working with the City on
its obligations over the granted lands and that it is used in accordance with the terms of
the granting statute and the public trust.
Annette Kirkham, an attorney with ICW Foundation of Silicon Valley, said she is
representing Redwood Creek Association and is a Docktown resident. She said the
City cannot afford to lose more affordable housing. She said the City has not met its
JOINT CITY COUNCIL/PLANNING COMMISSION May 12, 2014
MEETING MINUTES PAGE 15
MINUTE BOOK NO. 65
Page No. 162
