ATTACHMENT 1 RESOLUTION NO. 14-13 A RESOLUTION OF THE PLANNING COMICSSBON OF THE CITY OF REDWOOD CITY DENYING THE APPEAL OF JULBE ABRAHAM AND UPHOLDING THE DECISION OF THE COMMUNITY DEVELOPMENT DIRECTOR TO ELIMINATE A DEED RESTRICTION AT 20 AVONDALE AVENUE AND 150 EL CAMINO REAL WHEREAS, the prospective developer/owner of a property, David Hopkins, requested that a deed restriction which prevents the construction of any permanent structures within the 50-foot wide vacant parcel located at 20 Avondale Avenue, Redwood City, California ; and WHEREAS, on June 12 , 2014, the Community Development Director reviewed the request and associated materials, to consider the elimination of this deed restriction ; and WHEREAS , on June 12 , 2014 , the Community Development Director issued a Notice of Decision , granting the elimination of the deed restriction on 20 Avondale Avenue ; and WHEREAS , on June 27, 2014, an appeal of the Community Development Director's decision to eliminate the deed restriction was filed with the City Clerk by the Julie Abraham (appellant); and WHEREAS, on August 9, 2014, a public hearing notice was published in The Redwood City Daily News and mailed to interested parties and all property owners within 300 feet of the Property; and WHEREAS , on August 19 , 2014 , the Planning Commission of the City of Redwood City held a duly noticed public hearing in accordance with all applicable requirements of the State Planning and Zoning Law and the Redwood City Zoning Ordinance, to consider the appeal ; and WHEREAS , on August 19, 2014, the Appellant and all other interested parties were given the opportunity to participate in the public hearing through oral testimony and the submittal of written comments; and WHEREAS , on August 19 , 2014, the Planning Commission fully reviewed , considered , and evaluated the staff reports prepared for this matter, including the attachments to the staff report, oral and written public testimony, and all other documents and evidence in the public record on the matter and the appeal .
