ATTACHMENT 1 <br /> NOW THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF <br /> THE CITY OF REDWOOD CITY, AS FOLLOWS : <br /> 1 . The Planning Commission , having independently heard , considered , and <br /> weighed all the evidence in the record presented on behalf of all parties and being fully <br /> informed of the Project, the Community Development Director's decision , and the <br /> appeal , finds that Appellant has not shown , based on evidence in the record , that the <br /> Community Development Director's decision was made in error, that there was an <br /> abuse of discretion by the Community Development Director, that the Community <br /> Development Director's decision was otherwise improper, or that the City's notices, <br /> agendas, and appeal procedures were unlawful in any manner. This determination is <br /> based , in part, on the Notice of Decision , the staff report and attachments prepared for <br /> the Planning Commission hearing on the Project and the appeal , each of which is <br /> incorporated herein by reference. <br /> 2 . The Planning Commission hereby denies the appeal by Julie Abraham <br /> and , therefore, the decision of the Community Development Director to eliminate the <br /> deed restriction at 20 Avondale Avenue is upheld . <br /> 3 . In denying the appeal and upholding the Community Development <br /> Director's decision , the Planning Commission affirms the elimination of the deed <br /> restriction by the Community Development Director and set forth in the Notice of <br /> Decision dated June 12 , 2014 , and hereby directs the Community Development Director <br /> to prepare and record the documentation necessary to release the deed restriction . <br /> 4 . In denying the appeal and upholding the Community Development <br /> Director's decision to eliminate the deed restriction , the proposed project is not subject <br /> to the California Environmental Quality Act. <br /> 5 .
