Land uses with the possibility <br /> of attracting hazardous wildlife include landfills and certain recreational or <br /> agricultural uses that attract large flocks of birds. <br /> bf Due to their propensity to generate smoke, steam, and other visual and physical hazards to <br /> aircraft in flight,power plants should be avoided in the AIA.However, given the varying <br /> types of power plants (i.e.,thermal, solar farms,wind farms, etc.),proposed land uses of <br /> this type should be evaluated on a case-by-case basis, and in accordance with FAA criteria <br /> and the policies set forth in this Plan. <br /> c f In order to resolve any uncertainties or differences with regard to the significance of the <br /> above types of flight hazards, local agencies should consult with FAA officials and LVK <br /> management. <br /> 3.3.3.8'AvigatiomEasementIDedicationv <br /> Avigation easements transfer certain property rights from the owner of a property to the owner of <br /> the airport(i.e.,the City of Hayward). ALUCs may recommend the dedication of an avigation <br /> easement as a condition for approval of development on property to restrict the heights of <br /> structures or trees. Avigation easements should be dedicated to the airport owner as a condition <br /> for any discretionary local approval of any residential or non-residential development within the <br /> area indicated on Figure 3-5 (from the ALUCP). <br /> of The avigation easement shall: <br /> 1! Identify the potential hazard associated with the proposed project and its location <br /> within protected airspace; <br /> 2f Identify the airport owner's right to clear or maintain the airspace from potential <br /> hazards; <br /> 3 f Identify the right to mark potential obstructions and notify aviators of such hazards; <br /> and <br /> 4!
