4.7 Hold Harmless <br /> The Union shall indemnify, defend and save the City harmless against any and all claims, demands, suits, <br /> orders or judgments, or other forms of liability that arise out of or by reason of this union security Article, or <br /> action taken or not taken by the City under this Article. This includes, but is not limited to, the City's <br /> attorneys'fees and costs. <br /> ARTICLE 5-CITY RIGHTS <br /> To insure that the City is able to carry out its constitutional, chartered and statutory functions and responsibilities, <br /> nothing contained herein shall be construed to require the City to meet and confer on matters which are solely a <br /> function of management, including the right to direct the work force; to select and determine the content of job <br /> classifications; to hire, transfer, promote, suspend, discipline and discharge workers; to assign work to workers in <br /> accordance with the requirements determined by the City; to establish and change work schedules and assignments; <br /> to lay off workers for lack of work; to expand or diminish services; to subcontract any work or operations; to <br /> determine and change methods of operations; to determine and change work locations and the processes and <br /> materials to be employed;to take all necessary actions to perform its functions in emergencies. <br /> ARTICLE 6-STEWARDS AND OFFICIAL <br /> REPRESENTATIVES-AND RELEASE TIME <br /> 6.1 Stewards <br /> 6.1.1 The City recognizes the right of the Union to designate a job Steward to handle such <br /> Union business as may from time to time be delegated by the Union. A job Steward has <br /> no authority to take any action which interrupts the City's operations, or any action in <br /> violation of the law. The names of the Stewards so designated shall be forwarded in <br /> writing to the City's Personnel Officer and the City's Personnel Officer shall be advised in <br /> writing of any changes of Stewards thereafter. <br /> 6.1.2 The City will recognize a Steward selected by the Union as its representative in settling <br /> grievances with the City Management. It is understood and agreed that handling of any <br /> grievance will not unreasonably interfere with the duties of the Steward as a worker. <br /> Accordingly, a Steward who is released by a supervisor to investigate a grievance or to <br /> meet with City officials shall return promptly to his/her regularly assigned duties. <br /> 6.1.3 One Steward shall be relieved from assigned work duties by the supervisor to attend <br /> meetings arranged with management and to investigate and process grievances initiated <br /> by other workers within the same work area. In no event shall the Steward order any <br /> changes and no changes shall be made except with the consent of the appropriate <br /> Department Head. <br /> 6.1.4 The Union may designate a Chief Steward who may assist other Stewards in their duties, <br /> including being present at grievance meetings commencing with the procedures of Article <br /> 26.2.2. Such Chief Steward shall be subject to the foregoing conditions applying to other <br /> Stewards. The City recognizes that the Chief Steward may require more release time <br /> than Stewards. <br /> 6 <br />
