ATTY/RESO.3015/CC HERO PROGRAM <br />REV: 9-12-14 PT <br />Page 2 of 9 <br />WHEREAS, the City’s associate membership in the Authority would p ermit <br />the Authority to exercise the City’s authority to establish and implement a <br />contractual assessment program within the City under Chapter 29; and <br />WHEREAS, participation in a contractual assessment program that is <br />common to a number of cities and/or co unties permits allows for administrative <br />efficiencies and economies of scale that would not be possible if the City <br />independently exercised its authority under Chapter 29 to create its own <br />contractual assessment program; and <br /> WHEREAS, the City will not be responsible for (i) the conduct of any <br />assessment proceedings or other proceedings under Chapter 29; (ii) the levy and <br />collection of assessments; (iii) the conduct or prosecution of any remedial action <br />in the case of delinquencies in the payment of any a ssessments; or (iv) the <br />issuance, sale or administration of any bonds issued in connection with the <br />California HERO Program; and <br />WHEREAS, the City will have no financial obligation to the Authority (or <br />the holders of any bonds or other debt issued by the Authority); and <br />WHEREAS, the City will not pledge any money or assets of the City as a <br />guarantee of any contractual assessment levied in connection with the California <br />HERO Program (or as a guarantee of any bond or debt issued to fund <br />Improvements in connection with such a contractual assessment); and <br />WHEREAS, Chapter 23 requires that contractual assessments in <br />connection with the California HERO program will be levied by only with the free <br />and willing consent of the owner of each lot or parcel on which an a ssessment is <br />levied at the time the assessment is levied. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF REDWOOD CITY AS FOLLOWS: <br />SECTION 1. The recitals set forth above are true and correct in all <br />respects. <br />SECTION 2. This City Council consents to inclusion in the California <br />HERO Program of all of the properties in the incorporated territory of the City. <br />No assessment shall be levied by the Authority against any parcel in the City <br />except upon the request by and voluntary agreement of owners of the properties, <br />in compliance with the laws, rules and regulations applicable to the California <br />HERO Program. <br /> SECTION 3. The consent of this City Council constitutes assent to the <br />assumption of jurisdiction under Chapter 29 by the Authority for the purpose of <br />implementing the California HERO Program and authorizes the Authority, upon <br />9.B. - Page 8
