,. . . . u . . ..
that it could legally be made part of the agreement. Planning Director Patterson advised
that the proposed development roads do not meet City standards and could not be
- dedicated to the City. The utilities will have to meet the standards established for
Redwood Shores and "the City will not accept any utilities over garbage unless it meets
extraordinary standards, and if developed will be brought in by the developer and
checked by the City's engineering staff to make sure they could work before they are
adopted by the City Council." City Attorney Schricker expressed his concerns about
the present language regarding standards and the issue of dedication which might have
been inherited from the previous agreement, and suggested that if the Council wanted to
be clear about not accepting dedications, then the language in the development
agreement should clearly state that.
MEMO 1/18/95
Mayor Gasparini stated that the Public Hearing had been held and it was time to direct
staff to address certain issues, such as the one Vice Mayor Hartnett requested having to
do with the traffic assessment district, and the one Councilman Sanfilipo requested
having to do with removing the language relating to acceptance of roadway dedications.
MEMO 1/18/95
In response to Council questions, Planning Director Patterson advised that if the
Council put conditions into the agreement the developer did not want, the developer did
have the right to go back to the original, larger 1985 development agreement.
-
Councilwoman Steinfeld referred to Mr. Rodriguez's statement that the developer was
going to use the most conservative building techniques and she would like to have that
reflected in the record. Councilwoman Steinfeld referred to the top of Page 14 referring
to anyon-site improvements over or near refuse, and asked that staff change the
wording from may to shall be subject to an indemnification agreement; and, in that
paragraph include bonding for indemnification with a limited time period as was done
in Seaport Center, which was a five year indemnification.
MEMO 1/18/95
Councilwoman Steinfeld advised that the City did not know what capacity levels the
City had regarding water, sewage, drainage and other issues, and before those rights
were granted, staff should provide a complete report on current and future
commitments, including statistics on high and low rain level years.
MEMO 1/18/95
Councilwoman Steinfeld asked that decision on this matter be delayed until all the
information is received.
MEMO 1/18/95
-
MINUTE BOOK NO. 53
Regular Meeting Minutes Page No. 025
January 16, 1995
Page 16
