7.1.E. - Page 1 REPORT To the Honorable Mayor and City Council From the City Manager October 20, 2014 SUBJECT Access agreement between REG8 Sequoia Station, LLC ( "Regency ") and the City of Redwood City ( "City) for access to the Sequoia Station Shopping Center RECOMMENDATION By motion, approve and authorize the City Manager to execute the access agreement between the City and Regency to allow for groundwater monitoring and remediation analysis required by the San Francisco Bay Regional Water Quality Control Board ( "RWQCB ") at the Sequoia Shopping Center site. BACKGROUND Regency is the current owner of the Sequoia Station Shopping Center. The City and its consultant require Regency's approval to enter their property to conduct environmental monitoring work required by the California Regional Water Quality Control Board (RWQCB). In the late 1990's with the development of the shopping center, it was discovered that there was a hazardous material leak from a dry cleaning establishment that seeped into the City's sanitary sewer system. Investigations conducted from 1998 -2008 determined that the full extent of the groundwater pollutant plume was an area from El Camino Real to the Sequoia Station Shopping Center, located at 1001 -1111 El Camino Real. Tetrachloroethene ( "PCE ") and other chlorinated solvents released from Roy's Dry Cleaners, located at 1100 El Camino Road, and the sanitary sewer line beneath El Camino Real have potentially impacted nearby groundwater The RWQCB requires the City and Gary Bolton, owner of Roy's Dry Cleaners, to develop an investigation work plan addressing long -term groundwater monitoring and remediation. The City and its consultant, Groundwater & Environmental Services, Inc. ( "GES "), have prepared a work plan outlining groundwater monitoring and remediation options for the pollutant plume located beneath the Sequoia Station Shopping Center. The portion of the pollutant plume underneath Roy's Dry Cleaner's property is being addressed separately by Mr. Bolton. A prior access agreement with Regency expired in 2004, consequently, a new access agreement with Regency is required for the City to undertake the required studies.
