• <br /> 1 <br /> Discussing these! proposals , Joellyn Murphy said that lies using apartment <br /> managers at a dollar a unit would give the city some incc rie , and that while <br /> licensing at the State level would perhaps be a better arrangement , it might <br /> take years to accomplish. She said that among the principal methods of <br /> discrimination ir. Redwood City were denial that apartments were available and <br /> quoting higher rents to blacks . She pointed out that much of the fair housing <br /> area had been pre- empted by the State in the Rumford Fair Housing Act and urged <br /> the repeal of its pre-emption clause . She said that AB 1418 this session is <br /> aimed at doing so . <br /> The Committee proceeded through the recommendations , item by item. Mary Iierderson <br /> asked if any had been adopted by, the other three cities to which they have. been <br /> put , Palo Alto , I enio Park , and Cupertino . Joellyn Murphy said that some had . <br /> Mary Henderson asked if any junior colleges er crentl.y offer the short course <br /> for apartment mar•:-zgers ISCFH recommends be a requirement ..for licensing . Joei lyn • <br /> NurpL,- said that none (li , though Foothill College was considering it . She <br /> said ivCI"H had materials available for use in such a course , and lawyers willing <br /> to participate . Mary Henderson asked if she knew of any cities that required <br /> the licensing of managers . Joellyn Murphy said that she did not , and that the <br /> Rumford Act pre-empted the urea . Joellyn Murphy said yes ; they <br /> did. <br /> Mary Henderson said that when the state pre-empts an area it is "tilting e -c <br /> windmills " for a city to try to get jurisdiction back . She suggested that taybe <br /> the cities ought to get together and force the state to act in the fair housing <br /> area . <br /> Housing Aide Ransom asked how much area the pre-emption covered . City Manager <br /> Fales replied that pre-emption decides which agency is going to regulate an <br /> area , as opposed to levying a fee on it . Pre-emption generally covers regulatory <br /> business licenses , but not revenue producing ones . <br /> Mary Henderson observed that Item IWo , too, would fall under State pre-emption- - <br /> that apartment managers be required to maintain a list of all vacancies available <br /> and their rental terms . She suggested that repeal of the Rumford Act pre-eirption <br /> might be taking "a small step forward , a giant step backward" if Redwood City <br /> adopted ordinances that are a step forward , while other cities took a step <br /> backward . <br /> Joellyn Murphy said that that was true , but that obviously the statewide <br /> jurisdiction was not working--they have pre-empted the area but are obviously <br /> not going to take care of it . <br /> Charles Olivia, of Challenge Developments , said that the local office of the <br /> Department of Housing and Urban Development had made available posters advertising <br /> that federal fair housing law made it illegal to discriminate .
