VI CONSTRUCTION OBJECTIVES <br /> A. The City and YMCA buildings will be constructed with no common walls or roofs <br /> (exception may be breezeways between buildings) and will be situated to enhance <br /> efficiency and convenience for participants who wish to engage in both City and Y <br /> programs in different buildings. <br /> B. Intent to build a LEED certified project. <br /> C. Project construction may be time-phased to allow for a future building, such as a <br /> library or for construction phasing or fundraising. <br /> D. The design of the floor plans, schematics and construction drawings will be the <br /> responsibility of the City for City building(s)and the YMCA for the Y building(s). <br /> VII LEASE TERM <br /> 55 years, including construction period. Two, 10-year lease renewal options. <br /> VIII LEASE RENT <br /> $1 per year <br /> IX PREVAILING WAGE <br /> The parties agree that prevailing wages shall be paid for the construction of the YMCA <br /> and City facilities, as well as for improvements in all common areas. <br /> X FUNDRAISING AND DEVELOPMENT OF FINANCING PLAN <br /> The YMCA and City shall each develop fundraising strategies to help finance the costs of <br /> developing their respective facilities and common areas. However, such fundraising <br /> efforts shall be coordinated in a manner to avoid unnecessary duplication of targeted <br /> contributors. The parties shall use their best faith efforts to prepare their respective <br /> development budgets and identify their respective anticipated sources of financing by <br /> September 30, 2015. <br /> XI RIGHT OF ACCESS <br /> Upon request of the YMCA and execution of a Right of Entry Agreement, City agrees to <br /> allow YMCA and its authorized agents access to Red Morton Park for purposes of <br /> conducting physical and environmental inspections of the property. <br /> ATTY/AGR/2014.248/RWC&YMCA SILICON VALLEY L01 <br /> REV:11-20-14 PT <br /> Page 4 of 5 <br />
