City Attorney Thompson made clarifying comments <br /> regarding the process and the resolution before Council. City Attorney Thompson <br /> commented that the process being addressed in the resolution does not replace or <br /> modify the DTPP's existing rules and regulations and does not change the common law <br /> vested rights rule. She noted that instead the resolution amplifies the administrative <br /> process in the DTPP necessary to acquire a building permit and accordingly, <br /> developers are proceeding at their own risk until they acquire a building permit from the <br /> City. Ms. Thompson clarified that until applicants have a building permit, they do not <br /> have approval. She added that the resolution amplifies the process by which there will <br /> be a reservation of square footage of what is already in the books but it does not create <br /> a new legal obligation for the City Council. <br /> One Council Member inquired about transportation and Mr. Aknin said the Plan did look <br /> at various options and there is a recommendation to perForm a Downtown <br /> Transportation Study. He shared what is asked of the applicants right now and how a <br /> comprehensive transportation study is on the horizon. One Council Member appealed <br /> to developers to listen to the community and what it wants of projects, not just in terms <br /> of use and look, but also in terms of public benefits. <br /> One Council Member said that the City is not interested in throwing "wrenches" at the <br /> applicants, but things do change and due to the interest in Downtown, it is important to <br /> stop and reflect. This Council Member wondered if additional steps could be added and <br /> City Attorney Thompson said the resolution is fine and nothing is being changed but just <br /> clarified and amplified. Mr. Aknin added that each of the applicants had received the <br /> same exact letter regarding the process. <br /> Vice Mayor Foust inquired about the staff recommendation and how it relates to the <br /> "completeness" of a project. Mr. Aknin provided clarity on the matter. One Council <br /> Member was very happy that the Downtown Precise Plan is not cookie cutter but it is a <br /> market trend driven document and he supports that. Vice Mayor Foust noted she <br /> attended the Google Science Fair tonight with two other of her colleagues and it took <br /> place at Courthouse Square. Three youths will get a grant of$50,000 and this was a <br /> successful event downtown. Vice Mayor Foust is supportive of the recommendations <br /> she wants boutiques, small shops and other stores to come to downtown. She wants <br /> the awareness that we are in a very different time and day and she views this as a <br /> challenge and an opportunity.
