7.1.A. - Page 2 formed and met several times over a six month period to draft a Revised JPA Agreement. The agreed upon focus of the group was to: • Modernize the agreement to include relevant language and address the issue of compliance with the Standardized Emergency Management System (SEMS, California) and the National Incident Management Systems (NIMS). • Outline the over - arching responsibilities for the ESC and define the roles of the participants. During the review and revision process, it was determined: • The original JPA document is not on file with the California Secretary of State, which is required under the Government Code. • No Conflict of Interest Code has been adopted by the Authority and no Statement of Economic Interests (Form 700's) have been filed by Authority members representing their position on this particular Board. The First Amended Joint Powers Agreement was created and presented to the Redwood City Council on February 10, 2014 and was approved by member agencies throughout the County. The agreement was on the agenda for approval at the April 17, 2014 ESC meeting however, it was subsequently found to contain legal deficiencies which needed to be addressed. These changes included training and structure recommendations resulting in a new format that better complies with State standards. No other substantive changes were made since the agreement was approved at the February, 10, 2014 meeting. The current amended version has been vetted by multiple stakeholders, including Emergency Managers, Fire and Police Chiefs, City Attorneys and City Managers and as revised meets necessary legal requirements. ALTERNATIVES 1. Not approve and adopt the amended agreement reaffirming the City of Redwood City's membership in the San Mateo County Operational Area Emergency Services Organization, and direct staff to commence the process for terminating the original Agreement. FISCAL IMPACT No Budget Impact ENVIRONMENTAL REVIEW This activity is not a project under CEQA as defined in CEQA Guidelines section 15378, because it involves continuing administrative activities and has no potential for resulting in either a direct or foreseeable physical change in the environment.
