29 <br /> City Attorney Schricker advised that if Council members <br /> have any suggested changes they might be made at this <br /> time and could be incorporated into the proposed amend- <br /> ment at the time of the public hearing. Mr. Schricker <br /> stated there are certain clerical corrections he would <br /> wish' to make and that he has grave reservations about <br /> the provision for approval of advertising, believing <br /> it to be invalid. He observed that. the Planning Com- <br /> mission was advised of the objections to the section. <br /> Discussion followed and Mr. Schricker and Planning <br /> Director Schroeter replied to questions concerning in- <br /> tent of the Planning Commission, since they were advised <br /> of the objections to the provision for approval of ad-- <br /> vertising.- <br /> In response- to question regarding clarification of (e) <br /> on page 2 of the proposed ordinance; Mr. Schricker ad- <br /> vised that the paragraph is precisely as stated in the <br /> Civil Code and should not be changed as it has certain <br /> meaning in law . <br /> With regard to the first paragraph on page 7 of the <br /> proposed ordinance regarding tenant right of first re- <br /> fusal, Mr`. Schricker advised the paragraph should be <br /> redrafted . <br /> Mr. Schricker- advised that a public hearing is entirely <br /> discretionary and no such hearing is required by law. <br /> The motion carried unanimously by voice vote . <br /> Withdrawal of 2600 block of Broadway <br /> from _Downtown Improvement District <br /> City Manager Fales referred to his report of June 3, 1975 <br /> regarding the subject withdrawal and recommending the <br /> setting of a public hearing. <br /> City Attorney Schricker advised that the other merchants <br /> who are members of the Downtown Parking and Business <br /> Improvement Area No . 1 must be given notice of the with- <br /> drawal request and may reply in writing or orally. <br /> MOTION: Title having been read, Councilman Williams in- <br /> troduced the following resolution and moved, seconded <br /> by Councilman Barrett, its adoption: <br /> RESOLUTION NO. 7422 OF INTENTION TO DISESTABLISH • <br /> DOWNTOWN PARKING AND BUSINESS IMPROVEMENT AREA NO. <br /> 1 IN THE CITY OF REDWOOD CITY, TO ESTABLISH REDWOOD <br /> CITY PARKING AND BUSINESS IMPROVEMENTS AREA NO. lA <br /> IN SAID CITY, AND SETTING PUBLIC HEARING ON SAID <br /> MATTERS (public hearing set for June 23, 1975) <br /> The resolution was adopted unanimously by>rol1 call vote. <br /> Jr <br /> -3- <br /> Reg.Mtg. <br /> 6/9/75 <br />
