52 <br /> City Attorney Schricker advised that the public hearing <br /> is informal and that the Council is not bound as they <br /> might be under other circumstances to accept the pro- <br /> posed amendment, noting that some areas are unclear and <br /> the situation is fluid with regard to revisions . <br /> Mayor Weymouth invited anyone present who wished ?to <br /> speak to do so. No one wished to speak . <br /> Lengthy discussion followed and Mr. Schricker, <br /> Mr. Schroeter and Mr. Fales replied to questions and <br /> commented concerning sections of the proposed ordinance; <br /> the Council ' s philosophy with regard to the degree of <br /> regulation desired ; the possibility of providing greater <br /> Council guidance to the Planning Commission; whether or <br /> not problems are really anticipated in all of the areas <br /> covered by the proposed ordinance ; whether or not it is <br /> desirable to involve the City in enforcement of possibly <br /> private matters, and the probable considerations of the <br /> Planning Commission in preparing their recommendations . <br /> MOTION : Councilman Henderson moved, seconded by Council- <br /> man Rhodes, to close the public hearing. <br /> The motion carried unanimously by voice vote . <br /> The public' hearing was closed at 10 :09 p .m . <br /> MOTION : Councilman Henderson moved, seconded by Council- <br /> man Williams, to refer the proposed ordinance to the <br /> Planning Commission for consideration between the Plan- <br /> ning Commission and the City Council as outlined in the <br /> suggestions of the City Manager. <br /> • (NOTE : The City Manager suggested that the matter <br /> be referred back to the Planning Commission <br /> and that they be asked for an updated re- <br /> port on the background and their reasoning <br /> with respect to regulatory authority being <br /> imposed by the proposed ordinance , that they <br /> be asked to explain their rationale for their <br /> recommendation for heavy regulation; and <br /> then the Council might reserve their right <br /> to ask the Planning Commission to meet with <br /> them jointly in order to delve into the <br /> philosophy with regard to condominium de- <br /> velopment . ) <br /> CLARIFICATION : Councilman Henderson advised that it is <br /> the intent of the motion that before any joint meeting is <br /> held, the Planning Commission would make the requested <br /> report, and then perhaps a joint meeting would be held. <br /> The motion carried by majority voice vote, with two "No" <br /> votes recorded .
