52 City Attorney Schricker advised that the public hearing is informal and that the Council is not bound as they might be under other circumstances to accept the pro- posed amendment, noting that some areas are unclear and the situation is fluid with regard to revisions . Mayor Weymouth invited anyone present who wished ?to speak to do so. No one wished to speak . Lengthy discussion followed and Mr. Schricker, Mr. Schroeter and Mr. Fales replied to questions and commented concerning sections of the proposed ordinance; the Council ' s philosophy with regard to the degree of regulation desired ; the possibility of providing greater Council guidance to the Planning Commission; whether or not problems are really anticipated in all of the areas covered by the proposed ordinance ; whether or not it is desirable to involve the City in enforcement of possibly private matters, and the probable considerations of the Planning Commission in preparing their recommendations . MOTION : Councilman Henderson moved, seconded by Council- man Rhodes, to close the public hearing. The motion carried unanimously by voice vote . The public' hearing was closed at 10 :09 p .m . MOTION : Councilman Henderson moved, seconded by Council- man Williams, to refer the proposed ordinance to the Planning Commission for consideration between the Plan- ning Commission and the City Council as outlined in the suggestions of the City Manager. • (NOTE : The City Manager suggested that the matter be referred back to the Planning Commission and that they be asked for an updated re- port on the background and their reasoning with respect to regulatory authority being imposed by the proposed ordinance , that they be asked to explain their rationale for their recommendation for heavy regulation; and then the Council might reserve their right to ask the Planning Commission to meet with them jointly in order to delve into the philosophy with regard to condominium de- velopment . ) CLARIFICATION : Councilman Henderson advised that it is the intent of the motion that before any joint meeting is held, the Planning Commission would make the requested report, and then perhaps a joint meeting would be held. The motion carried by majority voice vote, with two "No" votes recorded .
