2 0 3.3 <br /> e) Carrying out the redevelopment project will further attain <br /> the purposes of the law by eliminating the incompatible land <br /> uses and lead to a general enhancement of the economic level <br /> of the community <br /> "The redevelopment program, as proposed, will enhance the economy of <br /> the City and restore the character of the area to be compatible with <br /> other commercial development in the downtown district The success <br /> of this program will provide a basis for better development of other <br /> projects in a similar manner within the City by creating financial <br /> independence and transforming the site into a high value commercial <br /> development " <br /> Al Davies, 1101 El Camino Real , automobile dealer and property owner in the <br /> Project Area, suggested that there are false statements contained in the <br /> staff report of October 21 regarding assessed valuation and advised the <br /> value of his successful automobile dealership has increased Mr Fales <br /> explained that the figures are for the entire Project Area and not just for <br /> the few successful businesses in it. City Attorney Schricker advised that <br /> the law contemplates that individual parcels within a project area may vary <br /> from the overall determination insofar as to what comprises the area, but <br /> that it is also anticipated that the project area will be a cohesive unit <br /> and that properties with higher assessed values than the norm may be in- <br /> cluded in the area <br /> Mr. Davies then stated his objections to the City being involved in a re- <br /> development program, hinted that certain interests may be attempting to <br /> obtain the property presently occupied by successful businesses in the <br /> area, and expressed concern regarding use of the power of eminent domain <br /> and his intention to fight it. <br /> Mr Fales stated for the record that Mr. Davies' remarks are subjective, <br /> that the power of eminent domain cannot be used arbitrarily, and there is <br /> no intention whatever of attempting to do so <br /> Mr Schricker stated for the record that there is no authorization to <br /> exercise the power of eminent domain at this time and that there is no <br /> Redevelopment Plan at this time. Mr Schricker requested that Mr Davies <br /> indicate his understanding of that statement noting that the legal signifi- <br /> cance must be fully understood <br /> Mr. Davies then acknowledged he understood the statement of the City Attorney <br /> Joe Balestra, 1037 El Camino Real , automobile dealer, stated that he under- <br /> stands the matter on which the Agency is voting tonight Mr Balestra ob- <br /> served that it is imperative that he and Mr Davies stay in business in <br /> their present locations and advised that he has offered to improve his <br /> property if certain help is given to him. Mr Balestra suggested certain <br /> developers are interested in his property, and it is his intention to fight <br /> to remain there <br /> Mr Fales stated for the record that he has personally communicated to Mr <br /> Davies and Mr. Balestra, making full disclosure to both, with regard to <br /> two developers who have expressed an interest in the Project Area, noting <br /> that both developers wish to carry out the aims of the General Plan and <br /> the Downtown Plan and neither developer has any involvement with any member <br /> of the Agency nor with the City staff. Further for the record, Mr Fales <br /> stated that _in view of_his personal communication with them on the subject <br /> there is no cause for the kind of innuendo being heard from Mr. Davies and <br /> Mr Balestra <br /> Mrs Henderson stated for the record that she is not aware of the names of <br /> any prospective developers of the Project Area <br /> -3- <br /> 11/17/75 <br /> Mtg #1 <br />
