Public Hearing - Appeal of-the denial by Report of Planning Director 8/4/81 <br /> the Zoning Administrator of the application Appeal letter 7/2/81 <br /> for Use Permit to allow conversion of a <br /> service station to a mini-market and Letter of Notice of Hearing to ARCO sent by <br /> gasoline facility, 610 Woodside Road - ARCO City Clerk 7/17/81 <br /> Petroleum Products Company, appellant <br /> Mayor Biagi declared open at 8:40 p.m. <br /> In response to question, Planning Director/Zoning Administrator <br /> Schroeter advised that the parking space requirements for similar <br /> markets not connected to a gasoline service station are applicable, <br /> • noting that six such spaces would be required for the square wig <br /> footage involved. <br /> Dale Greenfelder, 520 Compass Drive, Real Estate Representative, rwrY <br /> ARCO Petroleum Products Company, requested the decision of the <br /> Zoning Administrator be reversed and the application for a Use <br /> Permit granted. Mr. Greenfelder observed that the application was <br /> denied without consideration of the merits, because the Zoning <br /> Administrator wanted direction from Council as to the inter- <br /> pretation of the relevant provisions of the Zoning Ordinance. Mr. <br /> Greenfelder described studies made by his company regarding hours <br /> of operation, traffic, nature of the neighborhood, etc., suggesting <br /> there is a need for such a mini-market. He said that the station <br /> is to be operated by a self-employed businessman in the City who <br /> will have attended training school and met certain standards in <br /> order to obtain the franchise and that the interior of the building <br /> will be rebuilt and the exterior redesigned and painted. <br /> Discussion followed and Mr. Greenfelder, City Manager Fales and <br /> City Attorney Schricker commented and replied to question <br /> concerning the reported good record of existing mini-markets in the <br /> Bay Area; the intention of the appellant to obtain a beer and wine <br /> offsale license; the fact that the mini-market will not be expected <br /> to be the dominant use of the property either in terms of dollars <br /> or clientele; the concern of ARCO that loitering does not occur; <br /> the fact that the gasoline service station will be entirely <br /> self-service; and that anticipated use will be after the hours of <br /> regular grocery stores. <br /> Mayor Biagi invited anyone else present who wished to speak to so. <br /> No one wished to speak. <br /> M/S: Bury/Rhodes to close the public hearing.
