PUBLIC HEARINGS (continued)
lie
Item No. 6 (continued)
M/S: Rhodes/ to reverse the decision of the Zoning
Administrator and grant the Use Permit to allow conversion of a
service station to a mini-market and gasoline facility, 610
Woodside Road - ARCO Petroleum Products Company.
City Attorney Schricker advised that it would be inconsistent with
the Zoning Ordinance to take action at this time to grant the Use
Permit, since the Zoning Ordinance would not allow the 24-hour
operation of the facility contemplated by the applicant and there
may be other related problems or prohibitions in the Zoning
Ordinance.
In response to question as to why another station is permitted to
operate on a 24-hour basis, Mr. Schroeter advised that that station
is entirely surrounded by commercial property while the subject
station is partly adjacent to residential property.
It was pointed out that the report of the Planning Director
suggests Council give direction with regard to interpretation of
the Zoning Ordinance before consideration on the basis of merit of
the particular application is given.
MOTION WITHDRAWN: Councilman Rhodes withdrew his motion.
M/S: Bury/Rhodes to reverse the decision of the Zoning
Administrator denying the application of ARCO Petroleum Products
Company for a Use Permit to allow conversion of a service station
to a mini-market and gasoline facility at 610 Woodside Rod and to
refer the application back to the Zoning Administrator for review
of the merits of the specific proposal.
AMENDMENT: At the suggestion of Councilman Chandler, and with the
consent of his second, Councilman Bury changed his motion to add
that a "liberal" interpretation of the Zoning Ordinance be given
with regard to the subject application in so far as is possible
with all activities of the facility required to be totally enclosed
within a building.
The motion as amended carried unanimously by roll call vote.
MINUTE ODER NO. 81-138
•
REPORTS OF BOARDS AND COMMISSIONS REPORTS OF BOARDS AND COMMISSIONS
7. Report of Housing and Human Concerns Vice Mayor Stangel, Chairman of the Housing
Committee re internal reorganization and Human Concerns Committee presented the
Committee report.
John Clark, Vice Chairman, Park and Recreation
Commission reported that the Commission is
concerned because the reorganization of the
Housing and Human Concerns Committee
eliminates specific representation of one
member from each of several City boards and
commissions and substitutes nine "interested,
committed citizens." Mr. Clark said that the
Park and Recreation Commission wishes to be
certain of representation on the Committee.
Reg.Mtg.
8/10/81
Page 5
