(continued) M/S: Bury/Britschgi to close the public <br /> hearing. <br /> Carried unanimously and public hearing closed <br /> at 8:35 p.m. <br /> Discussion followed concerning the desirability <br /> of attempting to get more desirable development <br /> at one of the major entrances to the City; the <br /> traffic problems which the development may <br /> bring; the need for improvement of the property; <br /> the large percentage of open space planned by <br /> the appellant; and the difficulties which could <br /> be expected to be encountered by any developer <br /> of the small property. <br /> M/S: Britschgi/Leipzig to uphold the decision <br /> of the Zoning Administrator and deny the appli- <br /> cation for Use Permit for a drive-through <br /> restaurant (Ben Franks) at 491 El Camino Real. <br /> The motion failed on the following roll call <br /> vote: <br /> Ayes: Councilmen Britschgi, Leipzig and Mayor <br /> Biagi <br /> mon <br /> Noes: Councilmen Bury, Chandler, Rhodes, and <br /> Vice Mayor Stangel <br /> M/S: Bury/Chandler to reverse the decision of <br /> the Zoning Administrator and grant the applica- <br /> tion for Use Permit for drive-through restaurant <br /> (Ben Franks), 491 El Camino Real on the condi- <br /> tion that before a building permit is issued <br /> that: <br /> 1) landscaping is approved by the Department <br /> of Parks and Recreation; <br /> 2) provision has been made for maintenance of <br /> the landscaping; <br /> 3) the turning radius at the entrance has been <br /> determined to be adequate by the City <br /> Traffic Engineer; <br /> 4) the palm tree will be retained, if possible; <br /> 5) the applicant cooperates in the redesign of <br /> the configuration of access and egress to <br /> the property; <br /> 6) adequate resolution has been made of the <br /> problems relating to the light standard <br /> and the utility box; and <br /> 7) agreement has been reached that the appli- <br /> cant will provide a security guard if re- <br /> quested to do so by the City because of Imo <br /> a litter or loitering problem. <br /> moo <br /> Reg.Mtg. <br /> 9/22/80 <br /> Page 3 <br />
