Chand.Cen _ ._� <br /> Manguelcite Lei..pz-.g December 8, 1980 <br /> Bat Rhodes <br /> The Council of the City of Redwood City met on this date at 7:00 p.m. Imo <br /> as the Board of Equalization of General Improvement District No. 1-64 <br /> with Vice Mayor Stangel presiding. <br /> Directors present: Britschgi , Bury, Chandler, Leipzig, Rhodes and <br /> Vice Mayor Stangel <br /> Directors absent: Mayor Biagi <br /> Officials and staff present: City Manager Fales, City Attorney Schricker, <br /> Director of Finance/District Assessor Ference and City Clerk Hildebrand <br /> HEARING - ASSESSMENT APPEALS <br /> Vice Mayor Stangel stated that the Council is meeting as the Board of <br /> Equalization of GID No. 1-64 for the purpose of hearing appeals of • <br /> assessments on the Assessment Roll 1980-81. <br /> District Assessor Ference referred to his memorandum of December 8, 1980 <br /> advising that two appeals were filed and that Herbert Clough, owner of <br /> parcel No. 95-100-660, had telephoned and withdrawn his appeal on <br /> December 8. Mr. Ference advised that the only appeal to be heard is •rr <br /> that of Dr. Harold Payton Johnson, Jr. , noting that Dr. Johnson addressed <br /> the Board orally at the July 21, 1980 meeting. <br /> John Greer, representative of General Appraisal Corporation, the District <br /> appraiser, was sworn as witness. Mr. Greer described the drainage <br /> problem related to the only assessment appeal , stating that the matter <br /> has been remedied, and it is recommended that the assessment be reduced <br /> from $156,000 to $146,000. Mr. Greer advised that Dr. Johnson had re- <br /> quested a reduction to $120,000 which is deemed excessive, since the <br /> cost of remedy was some $1,000-1,500 for the drainage ditch and about <br /> $13,500 for landscape architect fees. Mr. Greer observed that some of <br /> the landscaping was beyond what was required to make the lot marketable, <br /> and that he believes the $10,000 reduction in assessment is equitable. <br /> In response to questions of City Manager Fales, Mr. Greer stated that the <br /> assessment is comparable to that of adjacent properties on the same block; <br /> that the reduction is based solely on the conditions peculiar to Dr. <br /> Johnson's lot; and that no kind of precedent is being set in reducing <br /> the assessment which is based on the cost to cure the conditions. <br /> In response to question regarding the $250 payment to Dr. Johnson by <br /> the Bren Company in exchange for a signed release from responsibility <br /> in regard to drainage problems, Mr. Greer conjectured that the small <br /> payment was a pacifying gesture, since Bren had very little legal lia- <br /> bility for the lot condition and Dr. Johnson was aware of that. <br /> Mr. Fales noted for the record that any future problems of the kind en- <br /> ■•• <br /> countered by Dr. Johnson would be the responsibility of the homeowners <br /> association, since common area is involved. <br /> Mr. Ference indicated that Dr. Johnson had orally expressed satisfaction <br /> with the recommended assessment reduction and is, therefore, not present <br /> tonight. <br /> Bd./Equal <br /> 12/8/80 <br />
