419
City Attorney Schricker advised that an applicant for reduction in
assessment must appear in person unless he signs a waiver in writing
and files it with the Board of Equalization or unless he enters into
a written stipulation as to the valuation of the property which is
approved as to form by the legal advisor of the Board and by the
Assessor of the District. Since Dr. Johnson has not done so, a pro-
cedural problem exists and no action is recommended pending receipt
o"° of the required documents or the personal appearance of Dr. Johnson
or his authorized representative before the Board. Mr. Schricker
Iwo stated that the hearing can be held open until the matter can be
handled as required.
Mr. Schricker noted that Dr. Johnson has checked his application indi-
cating he wishes to have "Findings of Fact" prepared. Mr. Ference
advised that although Dr. Johnson marked that box on the application
form, he did not pay the required $10.00 fee which must be filed with
the application as stated on that form, so no such Findings will be
prepared.
Mr. Ference advised that the withdrawal of application by Herbert
Clough was /done orally by a telephone call from his secretary today.
Mr. Schricker suggested that the Assessor write Mr. Clough confirming
the oral withdrawal and that the letter could then be presented to
the Board at the next Board meeting along with the documents from
Dr. Johnson.
MOTION: Leipzig/Britschgi to continue open the hearing on assessment
appeals for Harold P. Johnson, Jr. and Herbert Clough until 7:30 p.m. ,
Monday, December 15, 1980 in the Board of Supervisors Chambers at
which time the required documents can be expected to be presented to
the Board. MINUTE ORDER NO. 80-201
Carried unanimously by voice vote.
ADJOURNMENT
The Board of Directors adjourned at 7:25 p.m. , holding the hearing
open until 7:30 p.m. , Monday, December 15, 1980.
JACQUELINE C. HILDEBRAND
City Clerk
Bd/Equal .
12/8/80
Page 2
