Public Hearing - Resolution of Intention of Planning Commission record transmitted 3/12/80 wog <br /> Planning Commission to amend the Zoning Map <br /> to rezone property from R-4 (Multi-family- Mayor Biagi declared -open at 7:40 p.m. <br /> Medium Density) District to PF (Public ..Wr <br /> Facility) District - Sequoia Union High Affidavits of Publication of Notice of Hearing <br /> School, Broadway, El Camino Real, James and of Mailing reported on file. <br /> Avenue, Elwood Street and Brewster Avenue <br /> Ron Woodall, Assistant Superintendent of Sequoia <br /> • High School District, 76 Duane Street, opposed <br /> the proposed zoning and suggested it is capri- <br /> cious, arbitrary and discriminatory in that the <br /> Council evidently seeks to prevent the Board of <br /> Trustees of the District from closing the school <br /> at some future date and selling the property. <br /> Mr. Woodhall suggested City Council motives are <br /> suspect, since he believes Public Facility <br /> • zoning of the school property would impair its <br /> market value to the extent of making it unsale- <br /> able. He asked that the record show that the <br /> rezoning is proposed only to conform to the <br /> General Plan. <br /> • Lengthy discussion followed and 'Mr. Woodall, <br /> City Manager Fales and City Attorney Schricker <br /> commented, questioned and replied to questions <br /> concerning the fact that the Council is on <br /> record having adopted a "P-F". (Public Facility) <br /> District and instructed the Planning Commission <br /> to rezone sites used for that purpose to that <br /> designation; that the P-F District does not pre- <br /> • vent sale of the property since any prospective <br /> buyers can request prezoning; that Council has <br /> not and does not intend to use its zoning powers <br /> to block any school plans for property; that it <br /> Omml <br /> is the responsibility of Council to consider the <br /> impact of development of property in the City as <br /> a whole with regard to traffic, environment, <br /> etc.; that the act of zoning, property used as a <br /> public facility to a public facility zone is <br /> uncontestable; and whether or not the District <br /> has any relatively immediate plans for sale of <br /> the property. <br /> • .
