(continued) capacity has been allocated to the subject <br /> property by the City, observing that while <br /> there is no connection between zoning and <br /> sewer capacity, it is necessary to be practical <br /> in such matters, with any developer having to <br /> obtain sewer capacity. <br /> In response to statement from Councilman <br /> Britschgi regarding his participation in con- <br /> sideration of the subject while a member of the <br /> Planning Commission, Mr. Schricker confirmed <br /> that there is no legal barrier to Councilman <br /> Britschgi's participation in this legislative <br /> matter now. <br /> Steve Stern, President, BAS Homes, acknowledged <br /> sewerage is critical and that there are many <br /> steps to be taken before development of the <br /> property can take place, including withdrawal <br /> of the land from the Williamson Act under which <br /> it has enjoyed lower taxes as agricultural land. <br /> Mr. Stern projected slides of the area at <br /> present and of some BAS Homes constructed else- <br /> where, discussed lot size and traffic. <br /> Mr. Fales pointed out that the matter before <br /> Council is only prezoning of the property, not <br /> any particular future development of it. <br /> Barry Trailer, George S. Nolte and Associates, <br /> 1731 North First Street, San Jose, engineers <br /> for BAS Homes and author of the appeal, <br /> acknowledged that prezoning of the property <br /> to residential use creates value, if granted, <br /> stating that BAS is willing to amend their <br /> request to allow minimum lot size of 7,000 <br /> sq. ft. to insure the property would not be <br /> sold for more dense residential use than <br /> proposed by BAS as soon as it is prezoned. <br /> Chris Carneghi, urban economist, Mills- <br /> Carneghi, Inc., 235 Montgomery Street, San r"�4 <br /> Francisco, asked to show slides of tables <br /> indicating the suggested value of the proposed <br /> BAS development to the City and the current row <br /> economic situation of the owners. <br /> Discussion followed and Mr. Fales and Mr. <br /> Schricker commented and replied to questions <br /> regarding the relevance of any consideration of <br /> plans for the property or whether it is economi- <br /> cally viable in its present state to the matter <br /> before the Council. <br /> M/S: Rhodes/Chandler that any presentation <br /> related to specific proposed development of the <br /> property and its economic status be eliminated <br /> as not being relevant to the question before <br /> Council. <br /> Reg.Mtg. <br /> 5/5/80 <br /> Page 3 <br /> wrfil <br /> 9 <br />
