(continued) capacity which would set a dangerous precedent <br /> with regard to future flexibility regarding <br /> development within the City. <br /> Mayor Biagi invited anyone else present who <br /> wished to speak to do so. No one wished to <br /> speak. <br /> M/S: Chandler/Britschgi to close the public wag <br /> hearing. Carried unanimously and public <br /> hearing closed at 9:40 p.m. <br /> %mw <br /> M/S: Chandler/Britschgi to uphold the Planning <br /> Commission and deny the application of BAS <br /> Homes, Inc. to amend the Zoning Map to prezone <br /> property located at 125 Horgan Avenue from <br /> A-3/5-11 District to R-1 District, upon the <br /> findings that the application is not in the <br /> public interest and is contrary to the General <br /> Plan. <br /> Discussion followed concerning the need for <br /> consideration of sewer capacity with the Plan- <br /> ning Commission; the desirability of considering <br /> the entire acreage as a whole; whether or not <br /> the property owners of lands other than the <br /> subject property are ready to request such con- <br /> sideration; whether the Port has surplus <br /> sewerage capacity; whether residential develop- <br /> ment of the property might not be an improvement <br /> over what exists there at present; the need for <br /> housing; and whether Council would want to annex <br /> the property even if it is prezoned. <br /> The motion failed on the following roll call <br /> vote: <br /> Ayes: Councilmen Britschgi, Bury, Chandler <br /> Noes: Councilmen Leipzig, Rhodes, Stangel <br /> and Mayor Biagi <br /> M/S: Leipzig/Stangel that an ordinance be <br /> prepared reversing the decision of the Planning <br /> ormiiCommission and granting the application for <br /> prezoning of the 25.2 acres at 125 Horgan <br /> Avenue to R-1 District with minimum lot size <br /> set at 7,000 square feet. <br /> AMENDMENT: At the request of Councilman Bury, <br /> Councilman Leipzig, with the consent of Council- <br /> man Stangel, stated that it is the intention of <br /> the motion that the developer has the responsi- <br /> bility of providing the necessary sewer capacity <br /> for any use of the property. <br /> The motion as amended carried on the following <br /> roll call vote. <br /> Ayes: Councilmen Leipzig, Rhodes, Stangel <br /> and Mayor Biagi <br /> Noes: Councilmen Britschgi, Bury, Chandler <br /> Reg.Mtg.
