MJP : dft 08 / 28 / 90R ( 018 / 43 ) <br /> MJP : dft J8 / 30 / 90R <br /> flood , earthquake , explosion , drought or other natural <br /> disaster or by governmental action or inaction ( excluding <br /> action or inaction caused by City ) which prevents City from <br /> obtaining such service or supply sufficient for Developer ' s <br /> purposes when demanded by Developer ; provided , however , that <br /> such water or sanitary sewerage capacity , to the extent <br /> available , shall be provided to Developer on the same basis <br /> as other users . " <br /> 8 . AMENDED PROVISIONS RELATING TO COSTS , FEES AND CHARGES , <br /> The following provisions of Paragraph 9 of the Development <br /> Agreement are hereby amended to read as follows : GO <br /> N <br /> C <br /> " 9 . COSTS , FEES AND CHARGES . ( a ) Facilities Fees . N <br /> w <br /> Certain public improvements ( " Facilities " ) must be rp <br /> VT <br /> constructed as a result of , and for the benefit of the <br /> orderly development of all property within the District , <br /> including the Property . Such improvements consist of all <br /> Facilities as determined by City , for itself , and on behalf <br /> of District , to be of benefit to the District as a whole . <br /> The Facilities constructed prior to 1983 were financed <br /> by General Obligation Bonds issued by the District . <br /> Pursuant to Minute Order No . 83 - 22 , adopted February 28 , <br /> 1983 , and implemented by Resolutions No . 9304 , 9305 , 9306 <br /> and 9307 , adopted February 28 , 1983 , the City Council <br /> deauthorized outstanding bonds for funding of Facilities in <br /> the District following its declared intent , upon the <br /> adoption of Ordinance No . 1859 , on May 24 , 1982 , that future <br /> Facilities should be financed by the developers of new <br /> developments in the District , and not by the general funds <br /> 9 <br />
