J8 / 30 / 90R <br /> Developer from the South Bayside System Authority , for a <br /> period of ten ( 10 ) years from the sixth day of August , 1986 . <br /> (b ) City agrees timely to supply water when and as <br /> needed to Developer , in sufficient quantities to serve the <br /> needs of the Project , including , without limitation , potable <br /> usage , fire suppression and landscaping usage , for a period <br /> of ten ( 10 ) years from August 6 , 1986 . Developer shall be <br /> required to pay for water used at the same rates as other <br /> water users of a common water source connected to the City <br /> water system. CD <br /> N <br /> O <br /> ( c ) The Property presently has no storm drainage W <br /> connection to the existing storm drainage system and there �A <br /> Uz <br /> are no plans for such connection in the future . In <br /> accordance with the condition of Planned Development Permit <br /> No . PD- 10302 - 9 , Developer , at its cost , shall provide <br /> on-site storm drainage facilities with direct discharge into <br /> Belmont Slough . <br /> (d ) The provisions of subparagraphs ( a ) and (b ) hereof <br /> to the contrary notwithstanding , upon the expiration of the <br /> foregoing 10 -year period , City shall continue to make <br /> available and sell sanitary sewerage capacity and to supply <br /> water for the existing needs of the Project as then <br /> constructed , but City shall not be required to make <br /> available and sell sanitary sewerage capacity or to supply <br /> water when and as needed to Developer , respectively , if such <br /> sewerage capacity or water supply is restricted or <br /> unavailable to City because of interruption or interruptions <br /> in the service or supply thereof to City by reason of fire , <br /> 8 <br />
