Construction of the <br /> Project shall be sensitive to and consistent with the <br /> preservation and enhancement of tidal marshes , mud flats and <br /> other water-related areas to safeguard fish and wildlife <br /> habitats and indigenous vegetation . In this connection , the <br /> Project shall include pedestrian walkways , bicycle paths <br /> OD <br /> and / or other modes of providing public access to the <br /> C, <br /> landscaped water boundaries of , and lagoon areas within , the <br /> , ► <br /> Property , subject to reasonable regulation consistent with 0 <br /> tolD <br /> the commercial uses within the Property . <br /> 3 . DENSITY OR INTENSITY OF USE . Developer shall not <br /> construct more than 1 , 250 , 000 square feet of office buildings and <br /> 327 , 230 square feet of hotel buildings on the Property , not <br /> including the multilevel parking structures which have been <br /> approved as part of the Project . In addition Developer shall <br /> have the right to apply for approval to develop up to two ( 2 ) <br /> restaurants at the site . Such application shall be subject to <br /> requirements and conditions in effect as of the date of such <br /> applications . Developer shall construct no more than 3 , 000 <br /> 6 <br />
