7. AMENDED PROVISION RELATED TO ASSESSMENT DISTRICT. <br /> Paragraph 10 of the Existing Development Agreement is hereby amended to read as follows: <br /> 10. FUTURE OFF-SITE TRAFFIC IMPROVEMENTS . Developer shall be <br /> required to participate in an assessment district ("Assessment District") pursuant to the <br /> Improvement Act of 1911 (the " 1911 Act, " Sts. & Hwys. Code Sections 5000 et seq.); cc <br /> a) <br /> the Improvement Act of 1913 (the " 1913 Act" ; Sts. & Hwys. Code Sections 10000 e <br /> t <br /> C) <br /> seg.); the Benefit Assessment Act of 1982 (the " 1982 Act" ; Gov't. Code Sections <br /> Ina <br /> 54703 et .); and/or other fair share funding mechanisms, which include all existing <br /> and future Redwood Shores non-residential developments on an equitable basis for the <br /> construction of off-site traffic mitigation improvements. In furtherance of the <br /> foregoing, Developer hereby waives objection or protest to the formation or <br /> establishment of any such Assessment District provided that such Assessment District <br /> is consistent with the provisions of this Paragraph 10; provided, further, that the <br /> Property shall not be included in any such assessment district formed to construct <br /> improvements to streets located outside of the following boundaries : easterly of the <br /> easterly boundary if the right of way of Twin Dolphin Drive projected northerly across <br /> Marine World Parkway and southerly across Redwood Shores Parkway, westerly of <br /> U.S. 101 , southerly of the U.S. 101/Holly Street interchange or northerly of the U.S. <br /> 101/Ralston Street interchange. The area in which improvements cannot be funded <br /> pursuant to any such assessment district or other fair share funding mechanism under <br /> this Paragraph 10 is located outside of the shaded area depicted on Exhibit E attached <br /> hereto and made a part hereof.
