PHASING . Construction on the Project may be done in <br /> one or more phases ; provided , however , construction of public <br /> improvements shall be done in accordance with the conditions of <br /> Tentative Map No . 10805 - 4 , or the conditions of any resubdivision <br /> of the Property . <br /> 7 . EXISTING PUBLIC FACILITIES . <br /> ( a ) City agrees to make available upon request and to <br /> sell sanitary sewerage capacity to Developer for the same <br /> OD <br /> price the City pays for capacity , at the time such capacity C <br /> CD <br /> is obtained for Developer from the South Bayside System A <br /> Authority , for a period of ten ( 10 ) years from the date this <br /> Agreement is adopted by the City . <br /> (b ) City agrees to timely supply water when and as <br /> needed to Developer , in sufficient quantities to serve the <br /> needs of the Project , including , without limitation , potable <br /> usage , fire suppression and landscaping usage , for a period <br /> of ten ( 10 ) years from the date this Agreement is adopted by <br /> the City . Developer shall be required to pay for water used <br /> at the same rates as other water users of a common water <br /> source connected to the City water system . <br /> ( c ) The Property presently has no storm drainage <br /> connection to the existing storm drainage system and there <br /> are no plans for such connection in the future .
