Substantial completion shall mean the completion of construction of Cable <br /> System plant miles exceeding ninety-finro and one-half percent (92.5%) of the <br /> total cable-miles to be constructed, and the offering of Cable Service to at least <br /> ninety-two and one-half percent (92.5%) of the residences within the City. <br /> Satisfying this threshold shall not relieve Grantee of the obligation of Section 4.1 <br /> herein to provide Cable Service throughout the entire City. <br /> The percentage of completion shall be the ratio of completed miles <br /> of plant to the total plant miles to be constructed. As of the date of this <br /> Agreement, Grantee estimates that there will be approximately two-hundred <br /> seventeen (217) linear plant miles to be constructed in the City, of which one <br /> hundred forty-seven (147) will be aerial, and seventy (70) will be underground. <br /> (d) It is currently Grantee's intent to utilize an interactive "fiber <br /> optics to the service area" design in which optical fiber delivers signals from a <br /> central hub to nodes. The nodes shall interFace the optical fiber with interactive <br /> coaxial cables which distribute signals to Cable System Subscribers, and the <br /> node shall also serve as input-output points for interconnection to public <br /> buildings and businesses. <br /> (e) Grantee agrees that all Cable System passive nefinrork <br /> devices, including splitters and directional taps, shall be installed in vaults that <br /> shall be flush to grade. <br /> (fl If, within five (5) years after the effective date of this <br /> Agreement, Grantee shall, in any other Cable System Grantee or an affiliate of <br /> Grantee, owns or operates, installs active electronic equipment (such as nodes, <br /> power supplies and amplifiers) in flush to grade vaults, then within two (2) years <br /> after receipt of a written request from Grantor, Grantee shall retrofit the Cable <br /> 29 <br /> sh/RWC/Council <br /> AGMT-382 <br /> FXS/fs <br /> 08/02/00 <br />
