7.1.B. - Page 16 <br /> 5.3 Lease. <br /> a. To enable the Animal Control Contractor to perform the services <br /> contemplated by this Agreement for the entire term, each City <br /> understands that the existing Animal Control Contractor's <br /> leasehold of the animal care shelter located at 12 Airport <br /> Boulevard in San Mateo, California, is subject to the County and <br /> Animal Control Contractor's lease agreement and that the current <br /> lease shall extend at the rental rate of one dollar ($1.00) per <br /> annum, but only so long as the Animal Control Contractor's <br /> Services Agreement remains in full force and effect. <br /> Notwithstanding the above, when the County's proposed new <br /> shelter facility is ready to accommodate all services required to be <br /> provided by the Animal Control Contractor under the Services <br /> Agreement that are now provided in the existing facility, the lease <br /> will terminate. At such time, County will provide the Animal <br /> Control Contractor with 90 days written notice to, and the Animal <br /> Control Contractor shall within that 90 days, vacate the existing <br /> facility unless both parties agree to an extension. <br /> b. Once construction begins on the new animal care shelter to be <br /> located at 12 Airport Boulevard in San Mateo, California, presently <br /> anticipated to be during the summer of 2015, each City may <br /> participate on an Animal Care Shelter Advisory Committee. This <br /> Committee will convene at key junctures during the construction <br /> process to discuss the progress. It will also be used as a venue <br /> for each City to ask questions and share concerns. Meetings will <br /> be arranged and scheduled by County staff. <br /> 5.4 Facilities & Equipment. <br /> a. If the County chooses, at its own discretion, to replace equipment, <br /> at reasonable expense, but not to exceed $125,000, that is used <br /> by the Animal Control Contractor and/or the Animal Licensing <br /> Contractor solely for the purpose of providing services under this <br /> Agreement, Cities agree that they will be financially responsible <br /> for the purchase cost of said equipment based on their <br /> Proportionate Share of Cost as set forth in Exhibit B. <br /> In the event that any party asserts that an emergency safety- <br /> related repair is needed to the portions of the Peninsula Humane <br /> Society & SPCA facility located at 12 Airport Boulevard in the City <br /> of San Mateo that are used to provide contracted animal control <br /> services and/or the County chooses to replace equipment, at its <br /> own discretion, and the cost of said equipment exceeds $125,000, <br /> the Parties agree to meet in good faith to determine and agree <br /> 12IPage February 5 , 2015 <br /> ATTY/AGR/2015.057/SAN MATEO COUNTY-ANIMAL CONTROL SERVICES <br />
