Work with CITY and Contractor to maintain use of existing facilities that are <br /> affected by the construction, to minimize the disruption to the existing facilities <br /> and to have their continued use during the construction of the project. This <br /> includes all phase of construction and delivery of materials. <br /> 2. Monitoring of construction costs and progress payments, CM services shall include but <br /> are not limited to the following: <br /> a. Provide and maintain project level reports for budgeting and contingency <br /> tracking; contract payment status; cash flow forecasting and analysis; grant <br /> documentation; and other financial reporting as necessary to support the <br /> CITY's accounting needs. CM shall maintain records reflecting the actual <br /> costs for activities completed or in progress, including records relating to work <br /> performed on a unit cost basis and additional work performed by the <br /> Contractor on a time and materials basis. CM shall monitor and advise the <br /> CITY of costs pertaining to potential, pending and completed changes; and <br /> potential or pending claims. <br /> b. Develop a procedure for submittal, review and processing of the progress <br /> payments to Contractor, along with associated forms and reporting systems. <br /> CM shall review progress payment applications and work with Contractor to <br /> achieve agreement on the progress payment amount. CM will verify that the <br /> "as built" check set of plans by the Contractor are updated prior to approval of <br /> progress payment being submitted to the CITY. CM will require Contractor to <br /> provide a conditional waiver and release for progress payments and a final <br /> release and waiver for the final payment. CM will certify that the data in each <br /> application for progress payment is to the best of CM's knowledge, information <br /> and belief, the work has progressed to the point indicated in the application for <br /> progress payment and the quality of the work is generally in accordance with <br /> the contract documents. CM's review of application for progress payment <br /> shall be undertaken and completed in a timely manner so that the CITY can <br /> meet its obligations to make progress payment due Contractor within the time <br /> permitted by applicable law without incurring interest liability or other <br /> penalties/liabilities. CM shall also verify the progress payment satisfies any <br /> grant requirement. <br /> 3. Substantial completion and final completion, CM services shall include but are not <br /> limited to the following: <br /> a. Consult with the design consultants and CITY to jointly ascertain the <br /> achievement of substantial completion of the project. If upon inspection of the <br /> project substantial completion has not been achieved, the CM will assist the <br /> design consultant in noting the conditions of the work and the measures <br /> necessary for the Contractor to achieve substantial completion. Upon <br /> determining that the Contractor has achieved substantial completion the CM <br /> will coordinate the CITY's and design consultant's final inspection of the work <br /> to note punch list items to be completed by the Contractor as a condition to <br /> achieve final completion. <br /> b. Assist the CITY in issuing a certificate of substantial completion and final <br /> completion, as applicable. <br /> 4. Progress Records, CM services shall include but are not limited to the following: <br /> a.
