Developer is the current fee owner of that certain real property consisting of <br /> approximately 2.93 acres located within the City of Redwood City, County of San Mateo, State of <br /> California,described in Exhibit A,attached hereto and incorporated herein by reference(the"Property"). <br /> B. On May 7, 2013, the Planning Commission of the City of Redwood City adopted, <br /> among other approvals,Resolution No. 13-08, approving the Vesting Tentative Map for the construction <br /> of a two story health club with onsite surface parking and associated site improvements (the "Project"), <br /> prepared by BKF Engineers and dated March 3, 2013 ("Tentative Map"), subject to certain conditions of <br /> approval("Conditions"). <br /> C . The Conditions require either (1) that certain public improvements for the Project be <br /> constructed prior to approval of the final map ("Final Map"), or (2) that Developer enter into an <br /> agreement with City providing for the future construction of such public improvements. <br /> D . Developer has submitted the Final Map and applied to City for Final Map approval <br /> without having completed the required public improvements and, therefore,will enter into an agreement <br /> with City providing for the future construction and installation of such public improvements, as required <br /> by Government Code section 66462(a)(1). <br /> E. Developer has submitted to City plans, specifications and drawings entitled <br /> "Improvement Plans 24 Hour Fitness, 1050 Broadway Street", prepared by BKF Engineers and dated <br /> November 11, 2013 (the "Improvement Plans"), which, in addition to other improvements, provide for <br /> certain on-site public improvements consisting of street and street light improvements, storm drain <br /> systems, domestic water systems and sanitary sewer systems for the Project (collectively, <br /> "Improvements"). <br /> F.
