ATTY/DOCS-AGR/EMPLOYMENT AGREEMENT/AKNIN <br />REV: 06-17-15 PT <br />Page 2 of 5 <br /> 2. TERM. <br /> <br /> (a) The term of this Agreement shall be from the Effective Date and shall terminate <br />automatically without further action on the date on which a permanent City Manager commences <br />employment with the City, unless terminated earlier by either party in accordance with the <br />provisions set forth in Paragraph 3 or by the event of the death or permanent disability of <br />Employee. <br /> <br /> (b) Employee agrees to remain in the exclusive employ of City during the term of this <br />Agreement and not to be otherwise employed during the term of this Agreement except for part- <br />time teaching and/or writing, as otherwise allowed by the City Council in writing. <br /> <br /> 3. RESIGNATION AND TERMINATION. <br /> <br /> (a) Nothing in this Agreement shall prevent, limit or otherwise interfere with the right <br />of Employee to resign at any time from his position as Interim City Manager of City. Employee <br />may terminate this Agreement by submitting written notice of his resignation to City. Employee <br />shall give the City thirty (30) days written notice of his intention to resign. <br /> <br /> (b) Employee serves at the pleasure of the City and nothing herein shall be taken to <br />prevent, limit or otherwise interfere with the right of the City to terminate the services of <br />Employee as Interim City Manager with or without cause. There is no express or implied <br />promise made to Employee for any form of continued employment as the Interim City Manager. <br /> <br /> (c) In the event the City requests Employee to resign from his position as Interim <br />City Manager, or the Employee chooses to do so, the Employee shall have the option of <br />returning to his position as Assistant City Manager with the same terms and conditions of <br />employment that Employee received prior to the effective date of this Agreement, including any <br />cost of living adjustments normally received during Employee's tenure as Interim City Manager. <br />Notwithstanding the foregoing, returning to the position of Assistant City Manager or to any <br />other position shall not be an option the City is required to offer provided if City terminates <br />Employee for “abuse of office or position” in office as defined in Section 8. <br /> <br /> (d) Section 21 of the City Charter requiring a supermajority to terminate the permanent <br />City Manager does not apply to this interim appointment. <br /> <br /> 4. COMPENSATION AND BENEFITS. <br /> <br /> (a) City agrees to pay Employee for his services rendered pursuant hereto as Interim <br />City Manager a monthly salary of nineteen thousand four hundred and forty-six dollars ($19,446) <br />per month, payable in installments at the same time as other employees of the City are paid. <br /> <br /> (b) City will provide Employee with the same benefits and in the same manner <br />provided to executives pursuant to the City’s Executive Management Summary of Benefits in <br />effect on the effective day of this Agreement, except as specifically set forth in this Agreement, <br />7.1.J. - Page 4
