17 <br />6557.03/12309 <br />Section 2.11 Intentionally Omitted. <br /> <br />Section 2.12 otice of Airport Activities and Commercial/Industr ial Activities in <br />Vicinity. There are existing extended-hours, heavy commercial and industrial activities in the vicinity of <br />the Development, as well as airport flight operations associated with San Carlos Airport and San <br />Francisco International Airport, that may have perceived daytime and nighttime visual, traffic, <br />noise/vibration, and/or air quality-related nuisance effects. <br /> <br />Section 2.13 otice of Airport in Vicinity. The following notice is required by California <br />Civil Code Section 4255: <br /> <br />OTICE OF AIRPORTS I VICIITY <br /> <br />This property is presently located in the vicinity of two airports: San Francisco <br />International Airport and San Carlos Airport. The property is located in what is known as <br />an airport influence area for the San Carlos Airport which has a large number of takeoffs <br />and landings per day (300 per day in 2015). For that reason, the property will be subject <br />to some of the annoyances or inconveniences associated with proximity to airport <br />operations (for example: noise, vibration, or odors). Individual sensitivities to those <br />annoyances can vary from person to person. You may wish to consider what airport <br />annoyances, if any, are associated with the property before you complete your purchase <br />and determine whether they are acceptable to you. <br /> <br />Section 2.14 Guarantee of Access to Public Access Area. In accordance with the Public <br />Access and View Corridor Restriction Document, Declarant shall dedicate to a public agency or <br />otherwise permanently guarantee such rights for the public to the 64,674-square-foot public access area <br />located along the shoreline of the Property (the “Public Access Area”) and non-motorized boat launch. <br />The Public Access and View Corridor Restriction Document shall create rights in favor of the public <br />which shall commence no later than after completion of construction of any improvements in the Public <br />Access Area. Declarant shall provide evidence of recordation of the Public Access and View Corridor <br />Restriction Document to the Bay Conservation and Development Commission (the “BCDC”) and shall <br />not make any subsequent changes to the Public Access and View Corridor Restriction Document without <br />the express written consent of the BCDC. The Association and Unit Owners shall be subject to the <br />applicable terms and conditions of such Public Access and View Corridor Restriction Document. The <br />Association shall maintain the improvements located with the Public Access Area, as described in Section <br />5.1(g)(3). <br /> <br />Section 2.15 Open Space and View Corridor Restriction. The Development and <br />Association shall be subject to the terms and conditions of the BCDC Permit with respect to the open <br />space and view corridor described therein, and shall be further subject to the terms and conditions of the <br />Public Access and View Corridor Restriction Document as more particularly described on Exhibit B to <br />the BCDC Permit. The open space dedication shall allow construction of the development authorized in <br />the BCDC Permit and shall authorize landscaping that is consistent with the BCDC Permit. <br /> <br />Section 2.16 BCDC Permit Terms, Conditions and Restrictions. The Association and each <br />Owner of a Unit in the Development is hereby notified that the BCDC Permit contains terms and <br />conditions that restrict use of the Development, and contains provisions regarding public access or open <br />space and the need to obtain approval of construction plans prior to the commencement of construction in <br />the Development. Each Owner should read the BCDC Permit for further information concerning terms, <br />conditions and restrictions and how they apply to the Development and Condominium Units.
