18 <br />6557.03/12309 <br /> <br />Section 2.17 Marina Basin; Docks; Boat Slips; Boating and Water Activities. The <br />Development is intended to include a marina basin body of water, as well as a limited number of boat <br />slips and a publicly accessible hand boat launch. The construction of these facilities requires multiple <br />governmental approvals and there is no assurance that the required approvals will be obtained and that the <br />subject facilities will be constructed. If such areas and improvements are completed and made a part of <br />the Development as proposed, the owners and occupants of the Development may have certain limited <br />rights to access and use such areas, provided that use of such areas will be subject to the Condominium <br />Documents, applicable Association Rules and applicable government regulations. An owner or occupant <br />of a unit in the Development may not have an automatic right to access and use such boat slips, hand boat <br />launch or related facilities. Owners and occupants may be required to pay additional fees in order to <br />access and use such areas and facilities. Owners and occupants may be required to enter into an <br />agreement or lease with the Association or other entity before being permitted to access or use any boat <br />slip, hand boat launch or related facilities. Noise, odors, lights and vibrations and other potentially <br />disturbing issues may arise in connection with such marina or boating related activities, in particular for <br />those units located directly adjacent to the marina basin, boat launch, boat slips or docks areas. Users of <br />the marina, docks and boat slips and related improvements and areas in the Development will have access <br />to the Development, <br /> <br />Section 2.18 Landscape Maintenance Agreement; Assignment to Association. Declarant <br />shall have the right to assign its rights, responsibilities and obligations under the Landscape Maintenance <br />Agreement to the Association, using a form acceptable to the City Attorney of the City Redwood City, <br />and the Association shall be obligated to accept such assignment. Upon the assignment of Declarant’s <br />rights, responsibilities and obligations under the Landscape Maintenance Agreement to the Association, <br />the Association shall assume and be responsible for all obligations of the Developer described in the <br />Landscape Maintenance Agreement, including the costs related thereto. <br /> <br />Section 2.19 Stormwater Treatment Measures Maintenance Agreement; Assignment to <br />Association. Declarant shall have the right to assign its rights, responsibilities and obligations under the <br />Stormwater Treatment Measures Maintenance Agreement to the Association, using a form acceptable to <br />the City Attorney of the City Redwood City, and the Association shall be obligated to accept such <br />assignment. Upon the assignment of Declarant’s rights, responsibilities and obligations under the <br />Stormwater Treatment Measures Maintenance Agreement to the Association, the Association shall <br />assume and be responsible for all obligations of the Developer described in the Stormwater Treatment <br />Measures Maintenance Agreement, including the costs related thereto. <br /> <br />Section 2.20 Habitat Mitigation and Monitoring Plan; Assignment to Association. <br />Declarant shall have the right to assign its rights, responsibilities and obligations under the Habitat <br />Mitigation and Monitoring Plan to the Association, and the Association shall be obligated to accept such <br />assignment. Upon the assignment of Declarant’s rights, responsibilities and obligations under the Habitat <br />Mitigation and Monitoring Plan to the Association, the Association shall assume and be responsible for <br />all obligations of the Developer described in the Habitat Mitigation and Monitoring Plan, including the <br />costs related thereto. <br />7.1.K. - Page 22
