37 <br />6557.03/12309 <br />provided and maintained by the Association or subsequent owners of the Property through the Public <br />Access Area and the Public Access Easement. <br /> <br /> (5) The Association and any subsequent owner of the Property shall protect <br />the Property and condominium project from the threat of sea-level rise, storm surges, and other means of <br />sea water intrusion, and to adhere to Redwood City’s Floodplain Management Ordinance, Chapter 41 of <br />the Redwood City Municipal Ordinance. The City of Redwood City takes no responsibility or liability, <br />other than from a regulatory perspective, for the adaptive management necessary to maintain the <br />development of the Property, now or in the future. <br /> <br /> (h) In accordance with that certain Habitat Mitigation and Monitoring Plan for the <br />Development (the “Habitat Plan”) , the Association shall implement and maintain the best management <br />practices set forth in the Habitat Plan. Such best management practices are intended to minimize the <br />impacts to certain animal species caused by construction work and post-construction activity at the <br />Development. The Association shall also be obligated to comply with any management practices or other <br />guidelines related to the Habitat Plan provided to the Association by Declarant. <br /> <br /> (i) Pursuant to the requirements of the City of Redwood City, the Association shall <br />institute a street sweeping schedule of street and parking lot sweeping and an irrigation scheduling and <br />chemical management plan which shall govern the application of irrigation water and chemical <br />amendments to landscaped areas adjacent to buildings and within or adjacent to parking lot facilities. The <br />street sweeping shall occur at a frequency of twice monthly. <br /> <br /> (j) Ingress Egress Easement. The Ingress Egress Easement referenced in Recital B <br />of this Declaration and shown on the Map provides ingress and egress to and from the Development to <br />Bair Island Road. The Ingress Egress Easement is intended to include a roadway, sidewalks, pathways <br />and other improvements located on the Property and located off-site on adjacent property or in the public <br />right of way. The Association shall be obligated to maintain and repair the roadway, sidewalks, pathways <br />and related improvements in the Ingress Egress Easement area. The Association shall also comply with <br />the terms and conditions of any related documents or agreements provided by Declarant and shall accept <br />assignment and/or transfer of the obligations contained therein by Declaration to the Association. <br /> <br /> (k) Without limiting the foregoing in this Section 5.1, the Association’s obligations <br />of inspection, maintenance and repair shall include the on-site sanitary sewer system (including lift <br />station) on the Property, and the on-site domestic water, recycled water and fire water mains/services <br />behind the backflow preventers and meters and storm drain and storm water treatment facilities. <br /> <br />Section 5.2 Owner’s Right and Obligation to Inspect, Maintain and Repair. Except for <br />those portions of the Development which the Association is required to maintain and repair, each Owner <br />shall, at that Owner’s sole cost and expense, maintain and repair that Owner’s Unit, keeping the same in <br />good condition and repair. Each Owner’s responsibility for maintenance and repair shall include, without <br />limitation, performance of any inspection, maintenance and repair described in any applicable <br />homeowners manual, maintenance manual or manufacturers manual. Each Owner shall regularly and <br />actively inspect, or cause to be inspected by a qualified professional, that Owner’s Unit and any Exclusive <br />Use Common Area patio area appurtenant thereto in order to maintain the Unit and such Exclusive Use <br />Common Area in good repair, condition and appearance. Each Owner shall take no action that causes <br />degradation, damage or puncturing to any flooring or surface area of any patio area appurtenant to that <br />Owner’s Unit, and each owner shall be responsible for any such degradation, damage or puncturing <br />caused by such Owner’s action. Each Owner shall notify the Association promptly and without delay in <br />the event such Owner discovers and damage, crack, leak, hole, degradation or other problem with the <br />functioning of any portion of a patio area appurtenant to that Owner’s Unit.
