45 <br />6557.03/12309 <br />insurance policy to be canceled, causes a refusal to renew an insurance policy or impairs the structural <br />integrity of any building. To the extent storage of materials is permitted pursuant to the Condominium <br />Documents, such storage must be in accordance with building, fire, health and safety requirements as set <br />forth by governmental authorities and insurance carriers. <br /> <br />Section 7.3 Vehicle Parking and Operation Restrictions. No vehicle shall be parked, <br />stored or operated within the Development, except as permitted by this Section 7.3. The Association may <br />establish Association Rules for the parking of vehicles within the Development, which Rules may expand <br />or clarify the provisions of this section. <br /> <br />(a) Garages. Vehicles of any type may be parked in a garage appurtenant to an <br />Owner’s Unit. Garages shall be kept sufficiently clear in order to permit parking of the number of <br />vehicles for which the garage was designed. Occupants of a Unit must park their vehicles the garage <br />appurtenant to the occupant’s Unit. Garages may not be used solely for storage. No vehicle may be <br />parked in a garage if the vehicle is so large that the garage door will not close properly. <br /> <br />(b) Common Area. Only passenger motor vehicles may be parked in any <br />designated parking areas in the Common Area. All parking in the Common Area shall be subject to the <br />Association Rules. No part of the Common Area may be used for repair, construction or reconstruction <br />of any vehicle. <br /> <br />(c) Driveways; Aprons. Parking on any driveway, driveway apron or other apron <br />area adjacent to any Condominium Building shall not be permitted. <br /> <br />(d) Guest or Visitor Parking. No owner or occupant of the Development shall park <br />any vehicle in any space designated as guest or visitor parking. All guest and visitor parking areas shall <br />be used in accordance with this Section 7.3 and the Association Rules. <br /> <br />(e) Vehicle Restrictions. No trailer, camper, mobile home, recreational vehicle, <br />truck with carrying capacity of greater than ½ ton, van with seating capacity in excess of ten (10) persons, <br />boats, inoperable vehicle, commercial vehicle or any vehicle too large to fit within a single parking space <br />shall be parked or kept within the Development. For the purpose of this section, the term “commercial <br />vehicle” includes any vehicle defined as a commercial vehicle in California Vehicle Code Section 260. <br /> <br />(f) Removal or Towing of Vehicles. he Association may cause the removal of any <br />vehicle wrongfully parked within the Development or operating in violation of this Section 7.3, including <br />a vehicle owned by an Owner or occupant, to be towed and stored at the vehicle owner’s expense and the <br />Owner or occupant responsible for the presence of such vehicle shall indemnify, defend and hold the <br />Association, its Board Members, officers, managers and employees harmless for any damage to Persons <br />or property which may result. Before removing any vehicle as provided herein, the Association shall <br />comply with the requirements of Vehicle Code § 22658 in effect on the date of this Declaration or as <br />amended. If said Vehicle Code section is amended, this provision automatically shall be amended in the <br />same manner. The Association may install a sign at each vehicular entrance to the Development <br />containing a statement that public parking is prohibited and that all vehicles not authorized to park on the <br />Development will be removed at the owner’s expense. Such sign shall comply with the provisions of <br />Vehicle Code § 22658. Notwithstanding the foregoing, the Association may cause the removal, without <br />notice, of any vehicle parked in a marked fire lane, within fifteen (15) feet of a fire hydrant, in a parking <br />space designated for disabled persons without proper authority, or in a manner which interferes with any <br />entrance to, or exit from, the Development or any parking space or Condominium located thereon.
