<br />spill or drain from that Owner’s patio area. Owner’s shall keep water collection basins underneath all
<br />plants located in patio areas in order to prevent water from leaking from such plants onto or from the
<br />surface of the patio area. Patios shall not be used for storage of bicycles or any other items. Patios shall
<br />not be used for the drying of clothes. No clotheslines shall be permitted on patio. The flooring of patios
<br />shall not be punctured in any way. Nothing shall be attached or otherwise connected to the flooring of
<br />any patio in such a manner as that causes the flooring of the patio to be pierced or punctured.
<br />
<br />Section 7.25 Window Coverings. Curtains, drapes, blinds, shutters or other window
<br />coverings visible from the street or Common Area shall be restricted to a white or off-white color, unless
<br />expressly approved by the Board or the Architectural Control Committee. Windows shall not be covered
<br />with newspaper, aluminum foil, or other materials not designed for covering windows.
<br />
<br />Section 7.26 Architectural Control. In order to promote a harmonious and cohesive physical
<br />environment within the Development, and to prevent additions, alterations, or replacements which are
<br />reasonably likely to adversely affect property values throughout the Development, the Board is
<br />empowered to promulgate and enforce architectural controls and restrictions as described herein this
<br />Section. The ultimate responsibility shall remain with the Board, but the Board may delegate its authority
<br />to an Architectural Control Committee as provided herein and in the Bylaws. The Board or the
<br />Architectural Control Committee shall establish reasonable, objective standards clearly ascertainable to
<br />the Owners, and shall not act arbitrarily or capriciously in the process of reviewing plans. Such standards
<br />may include construction rules, including, without limitation, permitted hours of construction, procedures
<br />for access to a Condominium Building, noise controls, and other typical construction guidelines. The
<br />emphasis shall be upon uniformity of appearance, and consistency in carrying out Declarant’s original
<br />design and architectural scheme for the Development, as well as the integrity of acoustical, structural and
<br />waterproofing systems of a Condominium Building. The Board and the Architectural Control Committee
<br />shall base their decisions on what is in the best interests of the Development as a whole, and not upon
<br />what will appease a particular Member or group of Members. Both the Board and the Architectural
<br />Control Committee shall operate pursuant to the following guidelines:

<br />(a) No building, fence, wall, pool, spa, obstruction, outside or exterior wiring,
<br />balcony, screen, screen door, sunshade, patio, patio cover, tent, awning, carport, carport cover,
<br />improvement or structure of any kind shall be commenced, installed, erected, painted, repainted or
<br />maintained upon the Development, nor shall any alteration or improvement of any kind be made thereto
<br />until the same has been approved in writing by the Board or by the Architectural Control Committee
<br />appointed by the Board. Notwithstanding the foregoing, Owners may improve or alter any improvements
<br />within the interior boundaries of the Owner’s Unit, provided such improvement or alteration documents
<br />not impair the structural or acoustical integrity of any Common Area, the utilities or other systems
<br />servicing the Common Area or other Condominiums, and does not involve altering any Common Area
<br />(including roofs or bearing walls).
<br />
<br />(b) Plans and specifications showing nature, kind, shape, color, size, materials and
<br />location of any proposed improvements or alterations, shall be submitted to the Board or Architectural
<br />Control Committee for approval as to quality of workmanship and design and harmony with existing
<br />improvements, and as to location in relation to surrounding structures, topography, and finish grade
<br />elevation. No permission or approval shall be required to repaint in accordance with the original color
<br />scheme or in accordance with a color scheme previously approved by the Board or the Architectural
<br />Control Committee. No permission or approval shall be required to rebuild in accordance with the
<br />original plans and specifications or plans and specifications previously approved by the Board or by the
<br />Architectural Control Committee. Nothing contained in this Section shall be construed to limit the right
<br />of an Owner to paint or remodel the interior of that Owner’s Unit.
