14 | Page February 5, 2015 <br /> <br />breach of the Animal Control Contractor’s Services Agreement or <br />Parties choose not to renew the Animal Control Contractor’s <br />Services Agreement, County and Cities shall be financially <br />responsible for the remaining cost of any lease for vehicles or <br />equipment used by the Animal Control Contractor solely for the <br />purpose of the Animal Control Contractor’s Services Agreement. <br /> <br /> 5.5 Fiscal and Program Monitoring. Each City agrees to participate <br />annually with County to discuss financial or programmatic issues <br />including, but not limited to, licensing activities, revenue sources, <br />performance measures, and ordinance revisions. The County or any <br />City may request a special meeting for this purpose and upon the <br />provision of reasonable notice. <br /> <br />Any changes in the amount to be paid to the Animal Control Contractor <br />or the Animal Licensing Contractor shall require the Board of <br />Supervisors and the affected City’s approval. <br /> <br /> 5.6 Use of Program Revenue. Each City agrees that all fees collected by <br />the County and/or the Animal Control Contractor and the Animal <br />Licensing Contractor, or both, for the purposes outlined in this <br />Agreement shall be retained by the County and used to cover the cost of <br />services provided under this Agreement, except for services provided <br />directly by or for a City and where fees are collected by said City for <br />services provided as described in Section 3.4 and 3.6 of this Agreement. <br /> <br />Program Deficit or Surplus. The Cities acknowledge and agree that: <br /> <br />a. The Animal Control Contractor may retain half (50%) of all unspent <br />animal control contract funds with the written approval of the <br />County and exercise full authority over the use of its share, if the <br />County determines that the savings by Animal Control Contractor <br />have not impacted the quality of services detailed in this <br />Agreement. <br /> <br />b. County’s determination under Section 5.6(a) shall follow within 90 <br />days subsequent to County review of a mutually acceptable Audit <br />Report, defined in Exhibit C of this Agreement. <br /> <br />c. The Animal Control Contractor has agreed not to use these <br />savings to provide services which will add on-going costs to <br />services covered by this Agreement without written County <br />approval. <br /> <br />d. This Section 5.6 shall not apply to cost savings resulting from <br />decreased levels of service due to changes in each City, County
