AGREEMENT BE7WEEN`fHE COUNTY OF SAN MATEO AND <br /> THE PEN{NSUL.A HUMA�fE SOCIETY &SPCA,A CALlFORNiA NONPROFIT <br /> CORPORATION <br /> THlS AGREEMERtT, entered inta this 29 day of 1�ne 2p15 <br /> , � <br /> by and between the CaUNTY OF SAN MATEO, hereinafter caUed "County,"and <br /> PENINSUEA HUMANE SOCIETY& SPCA, hereinafter caifed "Contractor"; <br /> WITNESSETH: ' <br /> WMEREAS, pursuant to Gavernment Code Secfion 31000, County may contract <br /> wi#h independent conYractors fo� the fumishing of such services to or fQr County or any ' <br /> Department thereof; and <br /> WHEREAS, it is necessary and desirable that Contractor be retained for the <br /> purpose of providing animai care, contral and sheater services, as required under locai and <br /> state lavv and in the interest of the public safety and welfare, for the entire unincorporated <br /> territory o#the County of San Ma#eo and all cities of the Gounty of San Mafeo which have <br /> contracted with the County for such services (coNectively hereinafter, "Cities"); and <br /> WHEREAS, Contractor is a private, nonprofit corporation organized under the <br /> California Nonprofit Public Benefit Corporation law for charitable purposes, incfuding for <br /> the prevention of cruefty to animafs; and <br /> WHEREAS, County and Con#ractor (collectively herelnafter, "Pa�ties"}wish to enter <br /> into a writter� Agreement for Animai Contrn! and Sheiter Service�, in which Contractar <br /> agrees to petform and Cvunty agrees #o campensate Contractor for per#ormance of <br /> certain specified animal care, animal cantrol, and sheiter services (he�einafter, °Services . <br /> Agreement"}; and ; <br /> WHEREfi5, Parties entered into a written Lease Agreement, dated Ocfober 12, <br /> 1971, as amended (hereinaftec, "Lease Agreement"), in which County leased to ' <br /> Cflntractor and Contractor leased from County certain premises bcated at 12 Airport <br /> Boulevard in the City af San Mateo containing approximately 8.766 acres, more or less, at <br /> the rentai rate of one dollar($1.00) per annum for an initia( period of faur (4) years, ending ' <br /> August 31, 1975, and renewable at the option of Contractor for three {3) successive ' <br /> periods of twenty-five (25) years each upon written notice to the Coun#y, for use and <br /> occupation of Contractor in carrying out the animal care, cantrol and shetter services <br /> specified in the Services Agreement; and � <br /> WN�REAS, on or about August 17, 1976, Par�ies entered into an amendment of . <br /> the October 12, 9971 Lease Agreement whereby Contrac#or relinquished a portion o'f the <br /> leased area (identified as Parcel B on Exhibit A) and #he County added to the teased area � <br /> February�i,2Q15 .�_ � <br /> � <br /> � <br /> � <br /> i <br />
